The Hill has floated a plan to stop Donald Trump from taking office next month and declare Kamala Harris the next president of the United States. According to an opinion piece by Evan A. Davis and David M. Schulte, who worked as editor-in-chief of the Columbia Law Review and editor-in-chief of the Yale Law Journal respectively, Congress has the power to block Donald Trump from taking office because he has previously engaged in a so-called “insurrection.” The piece explains: The Constitution provides that an oath-breaking insurrectionist is ineligible to be president.

The provision in the Fourteenth applies to ‘officers’ who have taken the oath. The President is not considered an Officer under the Constitution. So this does not apply to him - among other well established reasons. But there must be a punishment for this type of public nuisance.
