Since Donald Trump’s reelection victory, some conservatives have discussed the possibility of using recess appointments, temporary appointments made while Congress is out of session, to fill positions in Trump’s new Cabinet. However, the discussions about recess appointments have generated more heat than light, with two groups frequently talking past each other.
Moreover, much of the discussion has focused on a scenario that seems unlikely to happen, could well get struck down in court if it did, and represents an unwise use of time and political capital. Herewith a few key points of analysis about the topic du jour inside the Beltway.

The peanut gallery always has its ominous recommendations. Trump is the president elect. Let him make the decisions and get yourself out of the way.

Trump will use any and all procedures that he needs to use. He will not be limited in his actions by a bunch of 'Ominous' mutterings.
Caution means hesitation which comes before defeat. Move boldly, or get out of the way.

I do not care how he/our side does it, just do it. I am sick of the hand wringing. The democrats use everything against us 24/7. There has never been any "reaching" across the aisle with them. We are fools to not use everything to our full advantage from now on.

IMO the real concern is not getting confirmation, but in getting rid of the Biden people.
Get rid of them the first day. Tell them to pack their S*** and hit the road. Place the new leader in their office and get the ball rolling and worry about confirmation later. Just rid of us the trash .

Yeah, I get it. President Trump is supposed to sit around twiddling his thumbs for weeks or months while a bunch of corrupt demonrats and rinos stall his appointments. Nice way to slow down throwing out the trash, that is, replacing corrupt and/or worthless bureaucrats throughout the bloated government behemoth.

The President CAN Adjourn Congress as he sees fit. Then he can appoint anyone he wants to...then after that term runs it's time, he can Adjourn Congress ....Rinse and Repeat. The language in Article II, Section 3 below says nothing about how or when that can be done, so it is up to the President and the Congress can Pound Sand if they don't like it!
Section 3.
He shall from time to time give to the Congress information of the state of the union, and recommend to their consideration such measures as he shall judge necessary and expedient; he may, on extraordinary occasions, convene both Houses, or either of them, and in case of disagreement between them, with respect to the time of adjournment, he may adjourn them to such time as he shall think proper;

Does it seem to anyone else that a lot of "The Federalist" writers have moved left in the last several months?
A lot of the articles that I have seen from there lately seem more like they should have come from "The Statist".

If my old feeble memory is correct, the Dems and their RINO pals in Congress made sure that Congress never was out of session long enough during the entire first Trump term to remove any possibility of recess appointment.
I don't believe that any other President in modern times was so restricted.
I would prefer nominees to be quickly approved by the Senate but if the Dems and RINOs hold them up, go with the recess route.

Advise and Consent is all the Authors of our Constitution have to say about Executive Officers. Many of the Authors of our Constitution became our President.
All the Authors who became President CHOSE their Officers with the Advise and Consent of the Senate by DAY 1 of their Administration. Fact!
I am hoping Supreme Court Justices, Thomas, Alito and Kavanaugh remember what Advise and Consent forced them to endure.
Supreme Court Justice Clarence Thomas described the Advise and Consent process as "A High Tech Lynching"
Advise and Consent brought charges of misogny against Chief Justice Alito and his Wife to tears in Public for all to see on TV.
and Chief Justice Kavanaugh is a "Rapist."
The Authors of our Constitution did not intend for or endure years of confirmation hearings.
The Authors of our Constitution, Senators and Presidents NEVER carried out their duties like we see today.
The wording in the Constitution in this matter has not changed but the interpretation has changed along with it's execution.
Who gave the Senate the power to do that?
I say we ask the Supreme's.

First, we need to tread carefully when expanding the President's authority; "separation of powers" was and is a key element of the Constitution. Imagine if Kamala Harris had been elected President?
Second, a big part of the problem relates to the sheer number of appointees that require Senate approval. In the early days, there were only a few such appointees, Maybe a solution would be to make only a few (State, Defense, and Attorney General, say), and the rest strictly appointed by the President?

Trump should - Trump can't. We overwhelmingly voted for Trump so he could get the job done so butt out. The reference to an Obama in the woodpile further strengthens our resolve. Much of his damage still needs to be repaired.

Trump is a one term President with the support of the people and no expectations of a political future. He is as free to impose his will on this feted swamp as he chooses. The bedwetting media has been discredited and exposed. If there ever was a time for a President to use the power of the office, now is the time. Any reform will be seen as a revolution and it is past time for tipping over their feed trough.

Christopher, I get what you are saying. But know that the President is always one step ahead of you on anything. Are potential recess appointments a bluff? We shall soon see.

I agree with poster #1...President Trump is in charge now...WE the people gave him the win he needed....to straighten out our country....not some second hand politicians or news commentators telling him what to do...I absolutely trust his judgments and appointments....if you want to run our country...then run for office and win the hearts of the people....THEN maybe I'll listen to your suggestions....for now....President Trump is MY man....
