Schumer rips 'MAGA' Supreme Court after
9-0 vote on EPA waters rule

Original Article

Posted By: Moritz55, 5/25/2023 5:07:59 PM

Senate Majority Leader Chuck Schumer, D-N.Y., slammed the Supreme Court's ruling Thursday that limited the Environmental Protection Agency's ability to regulate bodies of water, calling it a "MAGA" court even though the decision was 9-0. On Thursday, the high court issued an opinion that narrowed the EPA's broad definition of Waters of the United States (WOTUS). The court said the federal government must define WOTUS as a water source with a "continuous surface connection" to major bodies of water. The decision upended an attempt by the Biden administration to regulate wetlands, lakes, ponds, streams and other "relatively permanent" waterways, which had relied on a broad reading of the EPA's authority

Comments:

So now Sonia, Elena, and Ketanji have gone MAGA? Who knew?! 😮

The power-mad Fascists in Permanent Washington wanted to control every ditch, field, and puddle that occasionally filled with rainwater. The Supreme Court told them that if they want that kind of power they're going to have to ask Congress for it (this is a constitutional republic, remember?). Schumer knows that won't happen, so he calls the Court the dirtiest word he has in his repetroire: MAGA - Make America Great Again.

Maybe the judges considered taking a trip in the forest someday and needing to go behind a tree without the EPA regulating how they urinated. The EPA rules would have allowed that.

In other words, not even the most partisan and liberal justices could find a rule or statute that they could cling to so they could render a differing opinion. That's how extreme of a position the Obama/Biden EPA over-reached with their scheme.

When we were in the process of deciding where to build our home on the 1-1/2 acre lot we had purchased we had to have an EPA guy (cough, cough) review everything. He declared part of it a wetland because there was a tiny little creek at the back of the property and a spring in one corner. Did I mention he had just graduated college? Anyway, after some explanations he backed down. On the day we started putting in the foundation the ground was so hard the contractor had to use a big sledge hammer to pound the layout posts into the ground. The government is NOT your friend.

Schumer is that smelly stuff you scrape off of the bottom of your shoe sometimes so you don't track it into the house. I have read the majority of Alito's decision, but not yet the multiple concurring decisions of Kavanaugh, Kagan and Thomas. In any case, the SCOTUS has smacked down the thuggish EPA and limited their reach to the waters actually continuously in contact with interstate navigable waterways. The key phase seems to be "indistinguishable" from the clearly controlled waters. So a swamp along the margin of a lake is clearly indistinguishable and continuously connected to the lake. The EPA says that the plaintiff's property is "near" a ditch which sometimes flows into a creek, so of course the EPA thugs and thugettes decided that it was clearly a "wetland" that they controlled. Smack to EPA! Less reach for the EPA is always a good thing.

I am amazed at this being 9-0. Just amazed. In perusing the SCOTUS web page today, reading various rulings I ran across an odd one. Interesting that no news has noted that Kagan got a bit of a slap from the rest of the court for granting cert to a case referred cryptically as In Re Grand Jury, from the 9th Circuit. The full court's curt and polite decision is: "The writ of certiorari is dismissed as improvidently granted." This sounds like a smack to Justice Kagan who is responsible for "granting cert" for the 9th Circuit. I have never heard of a "cert" being dismissed without ruling. Perhaps it is more common than I imagine, but it seems like a substantial faux pas by Justice Kagan.

The agreement reached Saturday night between Speaker Kevin McCarthy and President Joe Biden is an historic first step toward shifting government back toward common sense and conservatism. It is a step toward creating a smaller government, lower taxes, less regulation, economic growth, prosperity, and more take home pay. All of this will also strengthen Social Security and Medicare. I emphasize it’s a first step because that is what I lived through in 1995 in our first year as a Republican House majority (the first in 40 years). Step by step, we got budget changes, moved from welfare to work, cut taxes, and reduced bureaucratic regulatory overkill.

What some mainstream conservatives and pundits aren’t considering, given our bleak 2024 electoral landscape (unresolved DNC-sponsored mass mail-in voting; an open border with millions of people streaming across it; an administrative state and media complex actively colluding and working against the people) is that Trump’s era was, and probably is, the last time flyover country will ever see executive representation in Washington again. Looking ahead to 2024, we should ask, Have the voters in that overlooked region—so breezily dismissed time and time again—changed in any marked way? Are they ready to move on? If anything, they’ve become even more alienated and disgusted by the Washington establishment than they were in 2016.
