Justice Ketanji Brown Jackson sided with a death row inmate in Ohio in her first written opinion since joining the Supreme Court this summer.
Jackson, who was joined by Justice Sonia Sotomayor, wrote a dissenting opinion objecting to the Supreme Court's decision to reject an appeal from Davel Chinn, the death row inmate, who was convicted of a 1989 murder in Dayton.
Chinn's lawyers had petitioned the court to take his case, arguing that the prosecution withheld evidence that a key witness who identified him as the shooter was mentally disabled.

The crime was committed in 1989, 33 years ago, and the sentence has not yet been carried out?

Actually, I find this case kind of interesting. I do believe prosectorial misconduct happens and I believe it has been happeneing for years in this country (anything to get a conviction), but I'd like to know why the majority ruled as they did, which was not given in this article. I'm going to assume this guy wasn't the only witness used to convict in this case.

It appears from the article that only she and the Wise Latina voted in favor of the killer. If that's the case she has showed her hand early. When even Kagan isn't on her side you know how radical she will be.

You can find more details of this case on the interest. Davel and his accomplice robbed and kidnapped a man who was walking down the street in Dayton. They drove the victim out of town and Davel shot him to death. The accomplice, Marvin Washington, testified against Davel. He himself was murdered about 3 years later.

I honestly doubt that neither Jackson or the "wise Latina" have ever read the Constitution of the United States.
They both probably think it a bit strange that they would have to take an oath "to support and defend the Constitution of the United States against all enemies, foreign and domestic". After all, what makes that ship in Boston Harbor all that important?

Maybe the prosecution was wrong to not let the defense drag the poor witness through the mud, but that doesn't change the fact that the prisoner committed a horrific crime that warranted being on death row.

With so many recent examples of prosecutor misconduct, I'm willing to give someone the benefit of the doubt. Just like it's a very low hurdle for police to get a warrant, it's also a little hurdle for the district attorney to give the defense complete discovery.
