Justice Amy Coney Barrett on Thursday rejected an emergency request by a group of Wisconsin taxpayers to block the enforcement of President Biden’s student-loan forgiveness plan.
Barrett, who typically fields emergency bids from Wisconsin, acted alone without referring the case to the rest of the Supreme Court bench or seeking a response from the government.
On Wednesday, the plaintiffs challenging Biden’s student-debt wipeout, which would effectively erase up to $10,000 in loans for graduates who earn less than $125,000 a year, filed an emergency petition to stop the government from implementing the plan pending litigation in the lower courts.

The Act that Biden is justifying his loan forgiveness edict was only intended for affected individual[s] who: (1) is serving on active duty during a war or other military operation or national emergency; (2) is performing qualifying National Guard duty during a war, operation, or emergency; (3) resides or is employed in an area that is declared a disaster area by any Federal, State, or local official in connection with a national emergency; or (4) suffered direct economic hardship as a direct result of a war or other military operation or national emergency.
It stipulates that (1) all institutions offering postsecondary education should provide a full refund (or credit) of tuition and related fees to students who are affected individuals for that portion of a period of instruction such a student was unable to complete, or for which such individual did not receive academic credit, because he or she was called up for active duty or active service; and (2) if affected individuals withdraw from a course of study as a result of such active duty or active service, such institutions should make every effort to minimize deferral of enrollment or reapplication requirements and should provide the greatest flexibility possible with administrative deadlines related to those applications.
Biden is claiming that because he declared a national emergency for COVID as subset of people suffered an economic hardship and should have their loans forgiven. The law clearly expects the institutions to forgive the debt and not be compensated by the Federal government. It may have gotten shot down for standing today, but Biden is violating the law by any reasonable interpretation of this statute.

Her rejection of the emergency relief was correct. Sorry, folks, but don't attack her for doing her job properly.Legal standing is going to be difficult to establish in this case, since the Congress can correct Biden's abuse of the 2003 law, but will not do so. And there will be too many constituents pleased with the forgiveness,
There is a concurrent problem with the forgiveness.
President Reagan's administrtion created the proper advancement towards a degree. The idea was that a student should not stay in school longer than necessary to finish their degree program and graduate.
Will this forgivemess spill over into the degree completion rule, and change it?

Once again a president grossly abuses his power and the only way to stop him is action by congress which is controlled by his own party. That is a clear flaw in the system. There needs to be a review of rules pertaining to standing. If it is unreasonable to consider impacted taxpayers to have standing (where would it end?) then there needs to be a better path for states to take action.

Congress long ago ceded their legislative responsibilities. I only hope that, not this time with McCarthy and McConnell, but future Republican Congressional leaders that Congress will stat doing its job again. I don't believe the Founders expected the federal judiciary to be body making laws, but that is what they have become since at least the 1960s.

So my daughter, who has no college debt, works and pays taxes, will be financing the “education” of people who make $50K more a year than she does.
And those who benefit from this “forgiveness” have no clue that they will be paying for it themselves out of their own taxes.
This should backfire big time on the dems just in time for the election if enough middle class taxpayers realize how badly TaliBiden is screwing them once again. Especially when they are struggling to make ends meet due to TaliBiden’s outrageous and intentional inflation.

Reason for all of LDot family juniors to apply for Merit Scholarships at each school their kids want to attend.
Both Daughters did, got full ride, plus great jobs on campus for spending $$… one at Sweet Briar in VA, and mucked stalls and exercised the horses, which she loved, the other at John’s Hopkins and worked for a prof.
Plan ahead, and pray a lot. It can be done.
Both are happily married now and have amazing jobs they love, one has my two Grandblessings.

McConnell, however contemptible he may be as a senator, teed up for confirmation and swearing in, 234 of President Trump's federal court nominees, including three Supreme Court nominees, 54 courts of appeals nominees and 174 for US district courts. The remaining 3 judges were confirmed to the US Court of International Trade. Barrett was nominated in September 2020, confirmed, and sworn in the following month, just prior to the 2020 elections. Given the approaching election, would it have been better for McConnell to have buried the vote on Barrett like he did Obama's nominee Garland in 2016? Or is it implied that McConnell strong-armed Trump to nominate a SC judge from the deep state bench? I doubt that Mitch or any other senator, could strong-arm a shoestring potato from Trump.

Very disappointing...but as a law abiding citizen...I accept her decision...and move on....this is biden's attempt at buying votes...it will not serve him well...because there are more voters who paid off their loans than dead/beats who didn't...so once again the democrats painted themselves into a corner...

Bide has been using our money as his. We have a budget that is set for each fiscal year and there are no funds for loan forgiveness. To go Ex-Budge Biden needs the consent of Congress. The Supreme Court needs to follow our laws and make them send Biden's request to Congress for their consent. Barrett knows this an should forget her personal politics and to step down from the Court if she can't..
