A U.S. judge appointed as a special master in the legal battle over records held at former President Donald Trump’s home said on Sept. 20 that he prefers not to see the materials marked classified that were seized by FBI agents.
“Let’s not belittle the fact that we are dealing with at least potentially legitimately classified information. The government has a very strong obligation, as all of us, to see it to that that information doesn’t get in the wrong hands,” U.S. District Judge Raymond Dearie, a Reagan appointee, said during a hearing in federal court in New York City.

There are no bounds the left will not exceed in their pursuit of Trump. The only defense we the people have is to vote the corrupt politicians out and Trump back in so he can remove the obviously corrupt leadership in the FBI & CIA. Without such a cleansing these Gov orgs will continue to be used as a weapon against anyone who does not agree with the progressive left.

Since the corrupt DOJ didn't argue against Dearie, from the very first, I assumed that he was just another Deep State operative camouflaged as an impartial jurisprudent.
I've yet to see anything to convince me otherwise.

Just thinking out loud here …. I’m not sure what he could glean from them … he really couldn’t make a judgment that some documents are not that important and therefore should not be classified… nor do i think he could decree that Trump declassified them …. nor that they were never actually classified. At least not without hearing lots of evidence.
But he could look to see if they were within the scope of the search warrant. I guess.

Someone stamped "Classified" on it, good enough for the judge, no need to verify.
GUILTY!
It does make it faster and simpler. the judge says he doesn't trust himself not to leak classified information so he is playing it safe. Yeah, this all makes perfect sense.

Does anyone really know if they were declassified, reclassified again or whatever? It appears DOJ do not want these to see the light of day. They are likely documents exposing the Russia hoax lies or worse.

Bovine Scatology. As mentioned by OP, Judge Cannon ordered Dearie to review all documents, whether classified or not. Judge Dearie already has a security clearance (he was a FISC judge who authorized surveillance of Carter Page, BTW) AND he has a need to know per his role as Special Master. Those are the two fundamental prerequisites to get access for any classified information.
Looks like someone pulled a John Roberts on Judge Dearie.

My understanding is that a huge percentage of government documents are called 'Classified' right off the bat - even if the topic is mundane and not terribly important. It's one way to keep everything a 'Top Secret'.

Why Trump didn't specifically declassify AND release these documents in Jan 2021 is beyond me. Yeah, yeah, I heard all that clap trap about "sources and methods." But the "sources and methods" are what led to the politically directed actions of Democrat operatives, intelligence agencies, FBI/DOJ and the Obama White House.

If the Republicans take over the House the House Intelligence committee can declassify documents. Same in the Senate. Each has slightly different rules but they can. Don’t remember if the House did this on some documents before the Dems took over.

I hate to break it to anyone, but there is not and never has been anything like a legitimate investigatory procedure in which the Deep State and Trump are antagonists. It is all sham, pretense and gaslighting with a single goal; to serve and protect the Deep State itself. If it requires lies, deceit, treason, perjury or any other illegal or immoral word or deed, so be it. Get used to it, peons. It's a big club and you (and I) ain't in it.

We should force the Biden's to tattoo "Classified" on their foreheads. That way no one would have to look at them too and wouldn't have to worry that they may be a National Security threat.

The judge is mistakenly thinking that documents that have been "classified" by bureaucrats have been done so for legitimate national security purposes, not as a political cover-up. The abuse of classification and our country's national security apparatus is at pandemic levels.

I don't see Trump's lawyers making any argument outside the one that these docs were declassified by the President before leaving office. No one claims anything involving any FBI cover-up as the motive for their original classification. (Correct me if I'm wrong here.) No judge is going to wade through boxes of documents looking for exculpatory/damning materials. That's the job of the white-shirted swells with a JD and their staffs - all those billable hours. The case largely hinges on FPDT showing the judge the documents seized were never or no longer classified. If he cannot, then FPDT has a problem with the law.

Well Judge, I would think the POTUS would not be the "wrong hands", and that he would have "a need to know". I think you can assume that, and as well, know that he can declassify anything at anytime by any method. Judge, you have seriously overinflated your pomposity, and appear biased against the defendant, which is very off putting. Your behavior to date is obnoxious. Please straighten up, and do what is right, instead of running your mouth where it is completely unnecessary to state any opinion, until the case has been heard.

Federal agencies for decades, in particular DoD, law enforcement and INTEL have over classified records to protect themselves. Trump started to shine some sunlight on the darkest corners and the agencies do not like it.

Dearie seems to think he doesn’t need to see the Classified docs. Meanwhile there is a kerfuffle about Trump’s lead lawyer James Trusty seeing them, even though he has security clearance. (How many FBI agents had a look at them at Mar-a-Lago? Did they have security clearance?) Judge Cannon said Dearie was to examiine ALL of the docs. Stay tuned.
