As RedState reported, Judge Aileen Cannon delivered a body blow to the Department of Justice, denying their request for a stay and appointing a special master in the case surrounding the FBI’s raid on Donald Trump. The DOJ had sought to exclude documents they deemed classified and to bring in a ringer who served as special master in the Michael Cohen and Project Veritas cases. Instead, all the documents will be reviewed by U.S. District Judge Raymond Dearie. That name caused some consternation because he is the same judge that signed off on the Carter Page warrant. But a judge can only work with what he has,

With the Jan 6th committee about to begin again (saw it on CNN at the gym; couldn't help it), I'm sure DOJ coordinated to add to that charade. Hope Judge Cannon's decision throws a wrench in their proceedings.

Once upon a time I handled classified information for the State Department all day, five days a week. Top Secret documents would come into the embassy where I worked and there were times when I had read the same information in the International Herald Tribune that very morning.

Judge Cannon could have done the right thing and declared the DOJ search warrant unconstitutional, but instead, we get the government circumlocution.

#2 I can go you one better. I once was involved in a patent infringement suit and we were initially denied access to "Confidential" documents from the plaintiff (we had been accused of infringement) concerning the origins of their patent claims. The Judge ultimately ordered the documents released and what an eye opener. Included among all the company docs and notebook pages were literally dozens of photocopied articles from the New York Times, Newsweek magazine and other widely read publications as well as scientific literature freely available to all. All of which had been stamped confidential, limited distribution. And no, there were no notations or comments written in the margins, the copies were pristine.
When opposing council was asked why they considered these public documents confidential their response was that the conglomeration of this information was a company secret, that if anyone could see it they would then know the proprietary patented process. Yeah, we were confused too. We won the case.

The Gestapo was after all the documents of Crossfire Hurricane that had the trail of all the money paid and crimes committed in Watergate II as instigators, antagonists and spies were embedded in candidate Trump's campaign. Stefan Halper, the G. Gordon Liddy of our day, was only one of a very large cast of criminals including the Schultzstaffel that begins with an F. Oh, and all the documents were DECLASSIFIED, but neither Billy Barr or Fascist Garland would release the evidence.

I'm thinking that this judge that was lied to for comey to get the surveillance on President Trump's 2016 campaign is in charge...and...I'm thinking he might just be pi--ed at being lied to about Russia...russia...russia...and ...will seize the opportunity in making amends for the mis/carriage of justice to American justice....and the American people...

Judges don't like being tricked, and they generally remember the embarrassment for a long time. The Bureau has much to answer for, and I suspect Judge Dearie will view any/all FBI claims with a jaundiced eye without 110% certainty. Perhaps Judge Dearie will be the Judge Sirica of this era. This case offers many strings to pull that may lead to unravelment. And wouldn't that be revenge served cold for His Honor?

I'm not at all confident Judge Raymond Dearie is going to be behave as many are hoping or predicting. Yes, he signed off on the FISA Warrant, but he should not have done so. He was too much of a rubber stamp. His suspicion should have been raised sky-high when the application for the Warrant included the assertion that Donald Trump was engaged in urination games with prostitutes. When any pleading submitted to a judge includes any assertion of alleged facts that are on their face nearly fantastical or "too good to be true" on behalf of the applicant, the judge should be highly suspicious of ALL of the other asserted facts. This judge is more than partially blameful for his being duped by this application, especially when Donald Trump was the subject of the Warrant.
