A Multnomah County Grand Jury has indicted security guard Logan Gimbel for fatally shooting a man in a North Portland parking lot in May.
Multnomah County District Attorney Mike Schmidt announced Thursday that Gimbel, 28, has been charged with murder in the second degree with a firearm, unlawful use of a weapon with a firearm, as well as three misdemeanor charges: recklessly endangering another person and two counts of unlawful use of mace in the second degree.
The shooting took place on the night of May 29 at the Delta Park Center shopping plaza. Gimbel shot Freddy Nelson, 49, through the windshield of Nelson’s Nissan Frontier
"Gimbel is tentatively set to stand trial on second-degree murder charges beginning on Oct. 19. All signs point to a hotly contested courtroom when the trial begins." It's Portland he will get a lifetime lol!

The fake cop was power tripping and killed a guy for stealing wood shipping pallets. The video does not show him aiming his car.
I'm all for instant justice but this wasn't it. They know who this guy is. They've filed paperwork on him. Have him arrested. If that doesn't work because of where they are, then don't leave the pallets in public and he'll stop coming around. They could slap a boot on his tires. They could have done a lot of things to eliminate this pest without resorting to gunfire.
Pepper spraying the guy in the first 15 seconds for no reason was a bad start and untrained clown just lost it from there. This guy lacks the training, discipline, public management skills and everything else necessary to be armed. He shouldn't even be allowed at a range.

This case represents a much bigger societal issue. As governments have handcuffed police,and police choose to avoid such situations (I have arbitrated such cases)Companies hire armed security guards, as would be expected, to protect their property and livelihoods.
Thieves and trespassers are less likely to obey a private security guard than a police officer.
The narrower issue is this. Is a motor vehicle a lethal weapon?
In most instances, yes. Except in Cleveland, Ohio, where Barack's 'Justice Department' forced the city to sign a consent agreement that said a police officer was never allowed to consider a vehicle as a lethal ,weapon.
Oops - one other point. In Erie, Pa, used pallets are a pain for holders of those things, and give them away. Craigs List offers free pallets here, every day.
And one more thing - I'm surprised the guard didn't shoot the wife. She be annoying.

The security guard acted inappropriately. What does he expect the guy to do, when he attacked him in the first place with the pepper spray? Sit there and say, "Thank you"? The guy started to leave. Had the guard not already told him to leave? Had the guard ever said, "I'm detaining you for the police."?
No, that WAS murder.

"In his right" doesn't make it right. The apparent fact is that the security guard could have "solved" the problem by calling the police to report the trespass and request assistance. The couple were a known commodity. No mention of previous violent behavior. They were apparently a nuscience taking used pallets for salvage. The guard told the couple to leave. The situation, IMO, needlessly escalated, and the security guard clearly contributed to the escalation. The guy tried to hit him? Why then did he apply the brakes and not simply drive off? I have a real problem regarding use of deadly force for such as this, even if one is "in his right" to shoot.

I wouldn’t justify the macing and shooting, but I can imagine the frustration of the guard having to deal with a chronic pain-in-the-butt like this guy. The drama has been going on for months.

The video/audio may not illustrate all of the facts in question; however, the guard ordered the driver to leave "his" property. The guard pepper-sprayed into the vehicle. It appeared the guard was actively preventing the driver from leaving the property as instructed, adding the element of confusion in following the commands to leave. First the vehicle moved to the driver's right to exit the parking space but the driver stopped so as to not hit the guard; next the driver backed back into the parking space, then turned hard to the left in his second attempt to leave. The video showed no clear intent to hit the guard as the driver hit the brakes when the guard once again moved in front of the vehicle. The guard was not heard to say that he was detaining the couple to await the arrival of police but pointed his weapon at the driver, a display of intent to unlawfully use deadly force. If the bullet holes in the windshield were lined up straight on the driver from the guard's perspective, as would be the case if the guard was standing directly in front of the driver, instead of at an oblique angle, then the guard's defense might be stronger than he was in danger of being run over. Also note the wheels were turned to the driver's left, indicative of the driver's attempt to leave the property, not indicative of trying to run over the guard. The driver hit the brakes when it was apparent the guard was impeding their exit.There appeared to be nothing about the guard's actions that were professional or lawful. Guards licensed in the state of California have a duty to know the state's deadly force laws. No state allows deadly force in response to someone shooting them the finger, which it appears in the guard's mind to have made the driver "bought and paid for" with regard to the lawful use of deadly force.

Geez ya'll...dead guy deployed pepper 1st, rolled down his window to do so. Security guy just had better aim and spray.
I do think however that security guy could have shot out tires or if he had positioned himself to the side could have stopped the event from accelerating to the point of needing to fire.
Stealing pallets is stealing, while some are single use and not worth much, others are expensive and owned not by the store but by the supplier of the protect, failure to return is charged to the store. Particularly import/export rated wood pallets which have to be heat treated and certified insect/disease free and resistant.
Pallet prices are up over 60% in the last 2 years, shortages are bottle necking supply chains, 48/40(most common size) are costing $250...up from $219 in march.(10 stack)
Reuse/recycling/re-selling pallets is a big industry few people have any awareness of..

Yup, #11 mostly because in Jersey, Pennsy, Virginia and Florida, (and I bet elsewhere)pallets are stacked roadside at businesses who WANT them removed-free of recycling charges.
Dude murdered the driver. Power hungry Little Man syndrome kills yet another.
