Gibson’s Bakery filed today its response to Oberlin College’s request that the Ohio Supreme Court exercise its discretion to hear the college’s appeal from the $32 million judgment (which includes attorney’s fees and costs). That judgment resulted from the $11 million compensatory and $33 million punitive damage awards totalling $44 million, reduced by the trial court under Ohio tort reform law to $25 million. The bulk of that reduction was that over $10 million in punitive damages were eliminated by punitive damage caps.

Comments:

Professor Jacobson noted that of all the documents he has seen regarding this litigation, Oberlin’s Memorandum In Support of Jurisdiction “may be the most tendentious, bordering on mendacious” and goes on to point out in one document, assertion of facts outside the trial record. Overall, the punitive damages of $33,223,500 constitutes less than 3% of Oberlin’s net worth. A quick search of Oberlin’s current assets: $1,437,500,000.

Methinks the bakery will lose this particular battle but it is fun to think that the school might owe millions more for their stupidity. Legal caps are the law regardless of what a jury might desire as punishment.

Attorneys for Gibson's Bakery in Oberlin have asked a Lorain County judge to order their clients be paid a $36 million-plus judgment they're owed by Oberlin College after the college failed to file an appropriate motion with a state appeals court.(Snip) As a result, the college should pay what a jury and court determined was owed the family bakery and its owners from a 2019 civil trial--plus interest, attorneys for the Gibsons argued.(Snip)"The bakery continues to labor under the effects of the stigma created" by Oberlin College and Raimondo, the Gibsons' attorneys wrote, "but without the relief awarded by the jury."

As posted recently, Oberlin College is seeking to have the Ohio Supreme Court hear an appeal from the massive $32 million judgment entered after jury trial in the Lorain County Court of Common Pleas as affirmed by the 9th District Court of Appeals. There has been an appeal bond place since trial issued by Zurich American Insurance Company securing the judgment plus future interest in the amount of $36 million, as a condition of a stay of judgment issued by the trial court.

In the coming days, the Nations that adhere to the World Health Organization (WHO) will vote on resolutions regarding the WHO’s management of pandemics. These resolutions will transfer sovereignty regarding the health of citizens to a supranational body that is largely financed by the pharmaceutical industry and the Bill & Melinda Gates Foundation. The immediate and most obvious speculation (including by me) was that the leak was by a liberal/leftist, likely a law clerk, trying to create a firestorm of protest that would pressure one of those five Justices to wobble, much like Chief Justice John Roberts reportedly switched his vote on Obamacare in 2012.(Snip)So an activist could leak using a false narrative that Alito represents the majority, can generate the protests and the energy in the base, can create an issue for the midterms, and at the end of the day, Roe survives, which can be spun as a victory for the protesters, proving the mob was able to intimidate the Justices.

The Washington state Supreme Court on Thursday ruled that a person’s race, and law enforcement’s long history of discrimination against people of color, should be taken into account when determining the legality of police seizures. The court also clarified state law to say police have seized a person if an objective observer would conclude that the person was not free to leave or refuse a request. But, the court wrote, that “objective observer” must be aware that discrimination and biases “have resulted in disproportionate police contacts, investigative seizures, and uses of force against Black, Indigenous, and other people of color.”
