An intense road rage dispute between two motorists in Florida landed one of them behind bars Tuesday after he pulled out a knife, prompting the victim to display a gun, authorities said. Rafael Vincent Rivera, 50, was arrested and charged with aggravated assault with a deadly weapon without intent to kill in connection with the confrontation in Palm Coast, about 80 miles north of Orlando, the Flagler County Sheriff's Office said. "Tragic disagreements should never result in violence in our streets," Sheriff Rick Staly said in a statement. Rivera was driving a Silver Toyota Tacoma when the victim cut in front of him with a motorcycle

Castle Doctrine, in general, relates to events inside your home. This event seems to have nothing to do with Castle Doctrine, although in some cases a motor vehicle is included in "your home" under some state laws. On a motorcycle.....seems a stretch of "your home", but perhaps there is some legal basis for calling sitting on your motorcycle the same as being inside your car.....IF Florida extends Castle Doctrine to your car, which I don't know. I'm no lawyer, but have extensively studied self-defense laws as part of teaching state required concealed carry courses, where explaining this is a part of the training. OP may be thinking of "Stand Your Ground" laws, which say that you have no legal duty to retreat in the face of a threat of violence when in a public place where you have a right to be. In many states, self-defense laws required or still require a person to retreat from a threat of violence in public, and not stay and defend themselves, if it could be reasonably assumed that they could retreat, basically unless trapped. The point of "Stand Your Ground" laws was to make a victim of an attack able to defend themselves in public places without requiring retreat. It may well be that "stand your ground" laws apply to this attack. Again, the motorcyclist showed good judgement in using the gun to persuade the attacker to halt his attack, and didn't shoot him. That is a VERY difficult judgement call, since any handgun is not instantly incapacitating in almost all cases, and one or two stabs can be effected after being shot and may well prove fatal. There is a law enforcement guideline that any person armed with a knife, within 21 feet is within deadly range, cannot be stopped before at least one stab can be effected, even with gun in hand, due to reaction time.
