A Manhattan judge on Monday said he will toss out Sarah Palin’s libel lawsuit against the New York Times over an editorial that falsely linked her to a mass shooting — but he didn’t exactly side with the Gray Lady. The former Alaska governor sued The Times – and the newspaper’s former editorial page editor, James Bennet – in 2017 after the paper published an editorial under the headline “America’s Lethal Politics.” But Manhattan federal court Judge Jed Rakoff said Monday he would dismiss the complaint when the jury returns a verdict because Palin had not met the high standard of “actual malice” in the complaint.

Now that the Post has published the judge's plan, why doesn't the jury just leave the building and go home? Why should they waste one more moment on this case? So then it's OK to chop away at a person's reputation as long as you're just a little mean and nasty and not eminently hateful and poisonous. So every publication and outlet can be a little mean to somebody, like Trump for instance, and get away with it. Good to know, I'll keep that in mind.

In a sense, the judge has done her a favor. Rather than grant a motion for nonsuit after the Plaintiff rested, the judge withheld his decision. The now case having been submitted for deliberation, almost all judges would now wait for the verdict. To dismiss the case and send the jury home at this point, only be reversed on appeal, would mean the judge would have to try it again. Left to deliberate, the jury either will find in her favor (and he vacates the the verdict), or the jury finds for the NYT. Either way she has an appeal, but much better that she appeals from a discrete legal ruling by the court rather than from a jury verdict. Moreover, the court's legal ruling is on thin ice, because element of malice is a mixed question of fact and law. The editor's self-serving testimony of negligence rather then malice is not conclusive, because the jury must always weigh a the credibilty of a self-serving party admission in the context of circumstantial evidence to the contrary.

The jury goes home every night. They will know about what the judge did and ask themselves why should they go back to court in the morning.

Bob Beckel, the longtime Democratic operative whose appearances on Fox News Channel included a stint as host of “The Five,” has died. He was 73 years old. FNC star Sean Hannity announced Beckel’s death during his nightly primetime show on Monday. “We miss him already,” Hannity said of his former FNC colleague, whom he called a “dear friend.” Beckel was campaign manager during Democratic Party nominee Walter Mondale’s ill-fated run for the presidency in 1984. He also served in the State Department during the Carter administration.

An effective and more affordable treatment for lung cancer may not gain approval after the Food and Drug Administration (FDA) complained about the lack of black people in its clinical trial, with a top FDA cancer official repeatedly noting in a meeting that it is Black History Month. Eli Lilly and a Chinese partner called Innovent believe the drug, known as Tyvyt or sintilimab, could extend the lives of those suffering with late-stage non-squamous non-small cell lung cancer (NSCLC), and be more affordable than other treatments. The clinical trial patients were Asian because the trial was conducted in China.

The Trafalgar Group is very accurate in its polling. It found 55.7% of voters prefer a Republican candidate in the upcoming congressional races. 42.2% prefer a Democrat. Let me put that in perspective. Remember the 2010 congressional races when the Tea Party flipped 63 seats for Republicans, which gave them their largest majority in decades? Republicans received 51.7% of the votes overall. Democrats got 44.9%. That was a 6.8-point gap. This is a 13.5-point gap.

McAuliffe receives 45 percent to Youngkin’s 53 percent in a new Fox News survey of Virginia likely voters. Youngkin’s eight-point advantage is outside the poll’s margin of sampling error. That’s a big shift from two weeks ago, when McAuliffe was ahead by five, 51-46 percent. State Health Commissioner Dr. Norman Oliver told 8News on Friday that he plans to mandate coronavirus vaccinations for Virginians once one is made available to the public. Virginia state law gives the Commissioner of Health the authority to mandate immediate immunizations during a public health crisis if a vaccine is available. Health officials say an immunization could be released as early as 2021. Dr. Oliver says that, as long as he is still the Health Commissioner, he intends to mandate the coronavirus vaccine. (snip) Under state law, only people with a medical exemption could refuse the mandate.

In an ideal world, maybe we could ignore what's happening in Ukraine but we have to see the world as it is, not how we want it to be: Russia is calling and wants its Ukraine back. I generally appreciate Tucker Carlson, but every time he discusses Ukraine and Russia, I bristle — especially when he contends that America has no interest in Ukraine. I know some of you might agree with Carlson, but you can be a solid conservative who is just as war-weary as the next guy and still see a security interest in Ukraine without being a neocon.
