Judge THROWS OUT Palin libel case against
New York Times because her attorneys failed

A New York judge has tossed Sarah Palin's libel lawsuit against The New York Times because her lawyers failed to produce evidence of the newspaper had actual malice against her. US District Court Judge Jed Rakoff made the ruling on Monday afternoon as the jury deliberated whether the Times defamed her by linking her to a 2011 shooting spree in Arizona. Rakoff said he will order the dismissal of Palin's lawsuit, but enter his order after her jury finishes its own deliberations. He added that he expected Palin to appeal, and that the appeals court 'would greatly benefit from knowing how the jury would decide it.'

Why would he have let the case even proceed if he already knew what he was going to do? After all, the NYT seems to have actual malice against Republicans, and certain Republicans more than others. Hope she can, and will, appeal.

This isn't the judges fault. Its the Supreme Joke of the United States' fault. The Supreme Joke ruled that public figures must meet an impossible bar (actual malice). Nice job they did. Made it impossible for public fighres to even get their day in court and the Supreme Joke washed their hands of these cases since they can never get pass the actual malice standard. I for one expect no less from the Supreme Joke.

Partisan justice. Abraham Lincoln was a racist i.e. had animus toward American slaves for whom he died but the NYT is innocent of animus toward Palin despite a long well rewarded streak of mockery of same. Who can believe these judgments.

Why did the judge do this before the jury gave their decision? He could have waited until after they reached their verdict so they could not be influenced by his decision. Could his early release of his decision be grounds for an appeal by Palin?

This judge left the courtroom early last week for his gig teaching...journalism at Columbia. Anyone surprised? This is the perfect case for SCOTUS to repeal New York Times v. Sullivan. It surprised me that the judge "threw out" the case after it went to the jury. How does that happen?
