New York—Mayor Eric Adams has made his position clear: city employees have to be vaccinated against COVID-19. But more than two dozen unions—including police, fire and teachers—are asking courts to block what will lead to mass firings. Angry municipal workers, who filed a lawsuit in Manhattan Supreme Court, argue that Adams’ mandate doesn’t specify that unvaccinated employees should be fired. Instead, they argue, alternatives like weekly testing and remote work should be offered. This is interesting, and worthy of a brief explanation from that esteemed arbitrator, the Lakerman. (That would be me.) Labor agreements contain standard language on discipline and discharge. "No member of the bargaining unit may be disciplined, demoted, or discharged, without just cause." Just cause means good reason, and in addition, contains steps that KI call due process rights. Arbitrator Daugherty, a few decades ago, established the Daugherty rules of just cause. There were seven parts of the Daugherty test. 1. Did it happen? (I have tried cases where nothing happened, but Management believed something happened. 2. Did the grievant do it? Something happened - missing cash, for example, but Management couldn't prove that the grievant took the money 3. Did the grievant know, or should have known, that what was done was wrong? Training records are vitally important in such a case. 4. Was there a full, fair and neutral investigation? This is where I part company with Daugherty. I don't expect Management to do a neutral investigation. 5. Was the grievant given the opportunity to provide his side of the story? 6. How were other employees treated for a similar offense? 7. Was the grievant given the opportunity to rehabilitate himself?

The administration is awarding $5 billion over five years to states to have them build thousands of electric vehicle charging stations. Another $2.5 billion will go out in grants to be decided later.
