An English woman with spina bifida is suing her mother’s former doctor for millions of dollars in health care costs and damages claiming that she should never have been born.
Evie Toombes, a 20-year-old equestrian show jumper from Lincolnshire, is suing her mother’s general practitioner, Dr. Philip Mitchell, for “wrongful conception” after he allegedly failed to advise her mother to take folic acid supplements before getting pregnant that she claims resulted in her birth defect, according to The Telegraph.
Toombes was diagnosed with lipomyelomeningocele after her birth in November 2001, a neural tube defect to the spine.

Generally, suits alleging 'wrongful life', have been denied by the courts. Modern jurists have trended away from that position but then modern judges have permitted trials for foolish claptrap almost reoutinely now under the guise that 'everyone is entitled to their day in court'. If the doctor had missed some available therapy which could have prevented the birth defect then he would possibly be liable but since only death is available to 'prevent' spina bifida once discovered in utero I hope the judge does the right thing.

This young lady should just shut up. I do not feel sorry for her or for her mother. 20 yrs ago all women who became were aware of the need for folic acid. It is the women of my generation who did not know. Once it became known what caused spinabifada women were advise to take folic acid...or at least prenatal vitamins. IF that mother did not do so, let the mother and daughter settle up. But I am appalled at a 20 yr old being so callus and ungrateful for her 1) life and 2) being about the jump horse. What the heck is wrong with her. If she is disgusted with life....leave. What a spoiled brat. I hold contempt for her and anyone who is pushing this crap.

this is just a case of some lawyer using the young lady in an attempt to set precedent. The young lady has nithing to lose and gets her 15 minutes if fane and the lawyer sees a large monetary reward (he'll get a karge %) and the possibility of a lucrative practice filing such suits.
My dad commented decades ago that we have too many lawyers and that's why tge "chase ambulances" and I have commented many times that our legislatures are mostly lawyers which write ambiguous laws which create business opportunities for their lawyer children. A self propagating system.

She is a competitive show jumper riding horses, and she is trying to blame her mom's doctor for something that he really had no control over? I would have thought that being a competitive show jumper would be excruciating on her back with that condition. Shame on that solicitor for taking her case. But then, the business of anything horse related is expensive. No wonder she is hoping for a windfall.

Hateful people do hateful things, like blaming someone decades later for something that that person didn't do. In any sane society, this would be tossed out of court permanently at the lowest, and earliest level.

Psst Honey, you can still choose "Abortion" for yourself, even at this late date. Medical costs do not seem to be that much of a burden if you can afford to be a Show Jumper, perhaps THE most expensive hobby.

Confusing "claim".
Lipomyelomeningocele appears fundamentally different from that of other neural tube defects, as it is not reduced in incidence by folic acid supplementation.
