District Attorney: Criminal Charges ‘On

The shooting on the set for the film “Rust” may result in criminal charges, said a New Mexico district attorney. District Attorney Mary Carmack-Altwies told the New York Times that officials are still investigating and “haven’t ruled out anything” on whether charges could be filed. Last week, actor Alec Baldwin was rehearsing a scene on the set of the Western film near Santa Fe when he discharged a loaded gun, killing cinematographer Halyna Hutchins and wounding director Joel Souza. Baldwin, who is also the film’s executive producer, hasn’t been charged in the incident. “Everything at this point, including criminal charges, is on the table,”

AB was showing off. No reason to pull back the hammer and then pull the trigger when practicing a cross draw. No reason at all - just showing off with total disregard for all present. Guilty of gross negligence at the very least.

My prediction: the armorer and the assistant director (who handed Baldwin the gun) will be strung up, but Baldwin and the director will skate. The family of the dead cinematographer will settle with the insurance company and sign a non-disclosure agreement. Baldwin will not be cast in future movies involving guns. When the furor dies down and he's no longer in legal jeopardy, Baldwin will become even more self-righteous and insufferable about restricting guns.

No 5 you are 100% correct with your prediction. Baldwin will skate. Shouldn't those involved in movies with guns be required to have firearms training so an accident like this won't happen? I don't mean just the person in charge of the guns but the directors.

IMHO, in addition to the personal liability of Baldwin himself, the elements that make his negligence as producer rise to the criminal level are: 1) A well-respected Hollywood armorer is on record as refusing the job two months earlier, citing safety concerns in combining the jobs of propmaster and armorer; 2) there had been two incidents of "accidental" discharge of weapons on the Rust set a couple weeks earlier; 3) the armorer eventually hired, Gutierrez-Reed, had a dubious safety record; 4) Rust crew members had been shooting at targets with live ammunition only hours before the killing, meaning live rounds were on the set and obviously accessible; 5) no shields were in place in front of the photographer and director. I rest my case.

Ultimately if you are holding a gun you are responsible for what happens with it. If you don't know what's in it , unload it, inspect it and load it yourself only when you are ready to use it.

Baldwin and Assistant Director Halls will be chaged with at least involuntary manslaughter per New Mexico criminal statutes. Halls because he recklessly told Baldwin the firearm was "cold" and Baldwin because Baldwin could have inspected the firearm to ascertain for himself whether Halls' assertion of it being "cold" was factually correct. New Mexico Statute 30-2-3, subsection B:. "B. Involuntary manslaughter consists of manslaughter committed in the commission of an unlawful act not amounting to felony, or in the commission of a lawful act which might produce death in an unlawful manner or without due caution and circumspection. Whoever commits involuntary manslaughter is guilty of a fourth degree felony." Under New Mexico statutes a fourth degree felony is punishable by a maximum of 18 months imprisonment and a $5,000 fine.

I just got a note on Facebook from a (liberal) cousin who now lives in upstate NY (VT border). She says Alec Baldwin is staying in her city. Wonder how he was able to quickly flee the jurisdiction of the New Mexico authorities. Well, just don't invite him over to show his gun expertise.

The jailing of the Jan. 6 riot defendants is not just an obvious miscarriage of justice, given the length of time they've spent in detention without trial. All over the world, great power governments are struggling with their respective tech giants for control of the social media platforms. China’s ongoing crackdown on big tech is the most conspicuous. “Take Jack Ma, founder of the e-commerce giant Alibaba.” The Party called the billionaire in, told him his forthcoming IPO was illegal, and served notice that any new initiatives would need the regulators’ approval. Russia’s not far behind. Moscow sees Google, Apple, Facebook, Twitter, and Amazon as a threat and wants them replaced by “sufficiently pliable domestic entities — such as Russia’s large tech conglomerates like Yandex, VK, and Sber.”

A new “peer-reviewed” paper has been released from Cornell University titled “Greater than 99% Consensus on Human Caused Climate Change in the Peer-Reviewed Scientific Literature.” The study is yet another attempt to convey the nebulous notion that widespread scientific consensus exists regarding the primary causal factor behind climate change. A previous study, spearheaded by climate blogger activist John Cook, concluded in 2013 there was “97 percent consensus.” Despite near-universal acclaim and its citation by leading policymakers such as the United Kingdom’s energy minister, the study was inherently flawed. Dr. Mike Hulme of the University of East Anglia explains, “The ‘97% consensus’ article is poorly conceived, poorly designed and poorly executed. It
