Several news outlets (Bloomberg below) are noting the Department of Labor, Occupational Safety and Health Administration (OSHA), has submitted the worker vaccine rule to the White House for review prior to publishing as an ’emergency temporary standard’. While this may be seen as disappointing by many, the moment the rule hits the federal register, it will be subject to lawsuits before implementation. Until the DoL/OSHA rule hits the books, the mandate is nothing except a statement of intent. Once the emergency rule is put into the register, then various state attorneys general and private sector employers or employees will be able to seek injunctions and challenge the legality

Also take note that OSHA has only ever done this 10 times in their history, and 5 of the 10 were overturned as being unconstitutional. OSHAs track record sucks on this (almost as bad as the track record of the vaccine itself).

I thought bills of attainder, writs to deny a person of their civil rights without a trial, were illegal. I think the unvaccinated, and the Jan 6 peaceful protestors have been denied their civil rights. This is an impeachable offense, as is open disregard for the law you swore to uphold; specifically, the immigration laws. And the deploying of military troops against the citizenry exercising the rights to protest and petition the government is also an impeachable criminal offense. I know the Republicans don't have any lawyers.

The administration is going to be hard pressed to justify why this is an emergency rule, allowing the government to circumvent standard rule-making policy that allows for a 30 to 60 day period of public notice and comment. Public comments can be from regular citizens but can also be from scientists, economists, technical experts, and others citing published reports, or providing relevant data or evidence regarding the effects of a proposed rule or the need for the rule. The forces behind Biden cannot allow that, so Biden must use emergency exemptions to push his rule through and only a hopelessly corrupt media or judiciary will go along with an abuse of power that pushes the country off a cliff.

Unlike President Biden, I haven’t flip-flopped. In fact, my opposition to mandates is growing stronger with each new anecdote and piece of information that shows not only how futile they are but how devastating these self-inflicted harms will be.
