A Texas woman shot and killed an alleged peeping Tom standing outside her bedroom window through the exterior wall of her home with a barrage of rifle fire, police say.
The shooting took place at around 11.15pm Friday on Irvington Boulevard in Houston, and when cops arrived at the scene, they said, they found the man lying dead on the driveway of the house. The woman was in her bedroom, and told officers that she became scared after she saw a man looking through her window.

Sadly, this happened in Houston, which has become a cesspool of lie-beralism from elected officials and judges.
If I were on her jury, I would never vote to convict her of anything. But, unless this guy has a long rap sheet for sexual-related crimes, he was outside when she shot him and so the "Castle Doctrine" won't shield her -- and the uber lie-beral DA in Houston will probably decide to charge her to make an "example" out of her.

So, don't stand in people's yards and look through their windows. I doubt that a jury will convict her, if it were to get that far, which it should not.

This could be a problem in some locations because I know where I live you can only use deadly force if you are in imminent danger of death or serious bodily injury. The perp was outside of the house and probably did not pose a serious threat unless he was armed and threatened. In Texas though, it might be justified.

I'm in Texas, I've got guns, I've got a license - I'm not sure how this will hold up, probably depends upon whether or not a peeping tom or rapes have been occurring in the area. Must admit, my first thought "did she even call the police first?" I live in the country, if someone is peeping in my window he's walked a long way to get there. I'd call the sheriff and if the person even tried to break in I'd unload my gun(s) on him.

The perp was outside her house but still on her property and trespassing at night. A sensible DA would decline to prosecute the shooter on the basis that she was frightened of this potential rapist/murderer.

Deadly force in self defense is supposed to be predicated on three things: opportunity, intent, and ability for imminent bodily harm.
I don't know about this one. If she's in her home, and he's looking in, I'm not sure how the defense can show she was legitimately in fear for her life. No visible ability to harm her, unless he showed a gun or some such. The opportunity is sketchy, since she's inside and he's outside. He can't get to her unless he came in. And intent to harm seems difficult too. It seems a stretch to say if all he did is look inside, that he had intent to harm.
It seems like the defensive firearm use was probably premature, based on the little bit presented here. It's a high bar, as it should be, to justify actually firing on someone.
