A coalition of housing groups led by the Alabama Association of Realtors on Thursday filed a lawsuit in federal court in Washington, D.C., challenging the latest eviction moratorium, calling the Biden administration's action "nakedly political" and "unlawful." "[T]he CDC caved to the political pressure by extending the moratorium, without providing any legal basis," the emergency motion says. "In substance and effect, the CDC’s latest action is an extension of the same unlawful ban on evictions that has been in effect since September 2020." "Justice Kavanaugh’s controlling opinion was clear that the CDC could not extend the moratorium past July 31 absent ‘clear and specific congressional authorization (via new legislation),'"

The government should never have been allowed to impose the moratorium to begin with. They have no authority, and that includes on the congressional level.

CDC has absolutely zero authority over housing, in any way, shape or form. Totally illegal, unconstitutional. The CDC needs to be permanently closed.

Funny. Didn't the Supreme Court already say that it wasn't legal to extend the moratorium? Are they going to pay attention if a lower court says the same thing? Note to jurists: This is in-your-face lawlessness. Unless you can get your own strong-arm enforcement group, you might as well put your head in a bag and breath for a while.

We can either let this percolate through the court system for three years, or Kavanaugh can issue an immediate injunction to stop this unlawful nonsense.

Why are there no republicans calling for Biden's impeachment? He is not securing the border, moving infected invaders around the country and disregarding the Constitution despite knowing he is breaking the law. If Trump could be impeached over a phone call and for a capitol protest march, Biden can certainly be impeached for real cause. Are there no republicans with a backbone?

Kavanaugh bears a lot of responsibility here. He should have just voted to uphold the law, which he agreed didn’t permit CDC to do this, rather than try to craft policy. Not the court’s job. And of course we have the 4 liberal justices voting for an outcome rather than ruling on the law. Yes Roberts, this includes you.

The reinstatement of the mask requirement comes a day after the CDC reversed course on some masking guidelines, recommending that even vaccinated people return to wearing masks indoors in parts of the U.S. where COVID-19 is surging. White says the mandate will allow the facilities to remain open to serve the public to reduce the heavy customer volume caused by the COVID-19 pandemic over the last year.
