A restauranteur in Illinois who has a patriotic streak has amassed fines of at least $200 because he’s flying an American flag outside of the business, a report said this week.Terry Trobiani, owner of Gianelli’s which specializes in hot dogs and beef dishes along a stretch of Highway 176 in Prairie Grove, said he was given tickets for “improper display” after a town official stopped by his establishment recently, FOX 32 in Chicago reported.“The next day the village administrator comes in and he gives me a pamphlet of the sign ordinance pertaining to flags,” said Trobiani. “He says you might want to read this.”

From the pictures it appears to be well inside of his parking lot at least 50 feet from the road. The chances of them blowing out into the road is insignificant. If there was a wind strong enough the flags would be the most minimal among the things in the road. There is no doubt in my mind that if this had been a BLM flag 5 times as big there would be no issue.

Prairie Grove, Illinois is just a few miles from where I grew up. If this Doug Underwood character was mayor in my town, he would have been frog-marched out after being tarred and feathered.

I’m guessing it’s about the flag on the left with the blue line that has the town official in a tizzy. The business next to his has american flags but smaller. They know he has a strong opinion and personality and they are doing a petty control game. It has nothing to do with fear the flags are going to blow into the street.

find and publish the name and address of the "village administrator"..
next..
have five hundred knowledgeable citizens go to his address and look
for violations of building codes, setbacks, chipped paint, etc..
let's see what it costs HIM/HER to comply with everything in "the pamphlet"

The city is being unfairly criticized. The city staff knows what is a flag pole as contrasted from a flag displayed on a flag staff. This Ordinance is content neutral regarding flags.
The flags on the flag holders affixed to his building (noted as being "staffs" in the Ordinance) do not violate either of the cited Ordinance provisions. The flags affixed to the building are not on "poles."
Apparently the owner was cited for flying two flags that previously were on flag poles. The only legal issue was the location of those two poles, and they are no longer being used.

Flying an American flag outside a business is a crime.
Burning down an American business is just fine.

Here is the ordinance...read it carefully...
4. Flags shall be permitted in all zoning districts subject to the following requirements:
a. Flags shall be displayed only on permanent flagpoles or staffs designed and constructed specifically and exclusively for flag display.
Now, this can be read two ways... 1) All flags must be flown on a permanent flagpole or staff, making a flag hanging in a socket anywhere, like on your porch, non-compliant and subject to fine. or, 2) Those socket and pole sets sold in many stores nationwide are indeed "constructed specifically and exclusively for flag display."
This is why the local town authorities had to run to the right-of-way issue, which is not the basis of the citations. If the town had a competent attorney, he would advise the town to cancel these citations and drop the issue, or see them tossed out by a judge. But, then, it is Illinois...
