With its decision Thursday in the voting rights case of Brnovich v. Democratic National Committee, the court closed its term with a decision that will resonate not just legally but politically for years to come. The 6-3 decision upheld Arizona’s new voting rules in Arizona over claims of racial discrimination. While the court said it would be imprudent to create a sweeping rule for all future such cases, it was equally imprudent for the Biden administration to ignore the forthcoming decision in filing a new challenge to Georgia’s new voting rights. The lawsuit against Georgia’s new voting rules was clearly timed to beat the court to the punch,

This is not hard. It's democrats who are against open, fair and transparent elections. They don't want chain of custody to be adhered and followed, particularly for drop-boxes, which be definition is disenfranchising other voters. They want to have activist third-party groups collect ballots, again without any chain of custody or ability to know if the ballot was pre-filled, or the actual voter signed the ballot. They don't want to clean up the voter rolls of people who've died. Now why would they fight so hard to keep dead people on active voter registrations? None of those are opening access to voting, but do diminish, and disenfranchise, the votes cast by the over-whelming majority.

Professor Turley is being naive. Garland knows his lawsuit will be rejected in the end, but between now and election day 2024, he can keep it active in federal court, maybe even finding a federal district court judge to enjoin the Georgia law from implementation.

The new suit may fail with the current makeup of SCOTUS, but probably not a packed court. In the meantime (between now and 2022 and 2024), there are very likely federal judges which would keep the law in legal limbo prior to the next rounds of elections.

The Dems know their law is unconstitutional. They just keep throwing stuff against the wall and hope that something sticks. Or that one of the "conservative" judges votes with them.

On Thursday, the Supreme Court upheld two longstanding provisions of Arizona election law, provoking widespread trepidation among the Democrats. In a 6-3 ruling authored by Justice Samuel Alito, the Court held that it was permissible for the state to limit ballot harvesting and out-of-precinct voting. Such limitations are commonplace throughout the country, but the Democratic National Committee (DNC) took Arizona to court claiming that they violated Section 2 of the Voting Rights Act (VRA). The DNC lost but appealed to the Ninth Circuit Court of Appeals, which inevitably ruled against Arizona. SCOTUS overturned that ruling. The panicked Democrats vehemently denounced the Supreme Court’s decision as an undisguised assault on democracy.

The Democratic Party's number-one priority is to pass a voting "reform" bill that would federalize elections under rules favorable to Democratic candidates. It's more important than infrastructure, or massive new social spending, or anything else, which is why House Speaker Nancy Pelosi and Senate Majority Leader Charles Schumer gave their election bill the designation H.R.1 in the House and S.1 in the Senate. The House passed H.R. 1 in a nearly straight party-line vote on March 3. (All Republicans voted against it and all Democrats, with the single exception of Representative Bennie Thompson, voted for it.) The problem for Democrats is that

Iknew that critical race theory was spreading rapidly through America’s institutions, including not just schools and corporations, but also the military. But I was still taken aback when the burger at my favorite tavern arrived branded (literally) as a CRT special. It was, fortunately, mere coincidence. The Clear River Tavern in Pittsfield, Vermont was not after all making a political statement. But almost everyone else is.The burghers in places as far-flung as Loudoun County, Virginia, Fort Worth, Texas and Langley, Washington have turned out in recent days at local school board meetings to protest the CRT-inflected curricula that their districts have been inflicting on students. West Virginia Sen. Joe Manchin has once again been masquerading as a moderate while colluding with radical Democrats to betray his constituents. His latest act of perfidy was a “yes” vote on a procedural motion that would have moved the pernicious For the People Act (S 1) closer to passage in the Senate. This violated a pledge he made to Mountain State voters three weeks ago in a widely published op-ed (Snip) He claims to have changed his mind after negotiating a compromise with Majority Leader Charles Schumer (D-N.Y.), but the bill on which Manchin voted “yes” was the same 800-page power grab introduced by the Democrats in March.
SCOTUS Wimps Out On
Obamacare—Again

Obamacare has once again been rescued by a Supreme Court that seems determined to keep it alive regardless of precedent or common sense. Thursday morning, the justices dismissed the latest case based on the dubious proposition that a coalition of 18 GOP states had no legal standing to challenge the “reform” law or its infamous insurance mandate. The majority didn’t deign to consider the merits of the lawsuit, which argued that the mandate was unconstitutional and inseverable from the rest of the statute. The Court’s cowardice drew a blistering dissent from Justice Samuel Alito, who accused the majority of ignoring decades of precedent in order to deny the states standing.

The Supreme Court sided unanimously with a Catholic foster agency in a dispute against the city of Philadelphia over whether it should be banned from participating in the city's foster program because it excludes same-sex couples. The group, Catholic Social Services (CSS), claimed that "Philadelphia’s attempts to exclude the Catholic Church from foster care" violated the First Amendment. Lawyers for the city, meanwhile, said that CSS "lacks a constitutional right to demand that DHS offer it a contract that omits the same nondiscrimination requirement every other FFCA must follow when performing services for the City." In a 9-0 ruling, the justices sided with Catholic Social Services.

The once high-flying California lawyer Michael Avenatti deserves a "very substantial" prison sentence for trying to extort millions of dollars from Nike Inc, U.S. prosecutors told a judge. The Wednesday night recommendation came one week after Avenatti's lawyers said their client should spend no more than six months behind bars plus one year of home confinement. U.S. District Judge Paul Gardephe is scheduled to sentence Avenatti on June 30 in Manhattan. Probation officers recommend eight years in prison for Avenatti, and prosecutors said federal guidelines recommend more than 11 years. Lawyers for Avenatti did not immediately respond on Thursday to requests for comment.

Senate Budget Committee Chairman Bernie Sanders (I-Vt.) says he won’t support a bipartisan infrastructure spending proposal unveiled last week because he believes it doesn’t do enough to address the needs of the country and shields the wealthy from tax increases. Sanders’s opposition means the proposal would need to garner at least 11 Republican votes in the 50-50 Senate if Senate Majority Leader Charles Schumer (D-N.Y.) puts it on the floor and the rest of the Democratic caucus votes for it. "I wouldn't vote for it," he told reporters Monday evening. "The bottom line is there are needs facing this country.

Those of Joe Biden’s public behaviors that align with classic dementia symptoms are escalating. In the past few days, he strongly exhibited two symptoms: A type of belligerence that’s a cover-up for confusion and memory loss and a paranoid fear of those in charge of him. I used to spend a lot of time in the company of doctors. What always fascinated me were the tales they told of dealing with patients with early-stage dementia. The most interesting point they made was that elderly people, so as not to lose face or admit their own fears, are superb at deflecting the questions aimed at assessing their cognitive skills and memory.
