Breaking: Prosecutorial Error With
State's Last Witness Creates Grounds
for Possible Mistrial in Chauvin Trial

Original Article

Earlier today the defense rested in the murder trial of former Minneapolis Police Officer Derek Chauvin, charged in connection with the in-custody death of George Floyd. Chauvin waived his right to testify on his own behalf, asserting his Fifth Amendment right to remain silent during the course of the trial. That was not a surprising development. But what came next was quite surprising, and potentially a critical moment in the case for the prosecution. The prosecution advised the Court that it would have one rebuttal witness. A rebuttal witness can be called to present testimony in response to evidence heard

Comments:

One way to avoid riots - keep declaring mistrials.

I don't think that there is a plan to let a good riot go waste just because of a mistrial.

I'm watching the trial as a 'mere arbitrator' (quoting a federal district court judge, on a case I was selected for, and I had great fun in writing that award - the female judge, in prior rulings, had made a mess of a sex discrimination case) and today, I believe the judge made an irreversible error, by allowing any rebuttal testimony from the pulmonologist.. Perhaps of greater importance is that the judge apparently limited testimony on the police department's procedures and training. That would be grounds for appeal, as well.

The city will burn regardless of the outcome. Mistrial will yield riots. Full conviction will produce riots. If he gets convicted of a lesser charge, nationwide riots. If he gets off, then all h&ll breaks loose.

It makes no difference to the rioters if there is an acquittal, a mistrial, or a guilty verdict If there is a guilty verdict..hey let's celebrate with some new NIKE sneakers. If he is found not guilty...let's burn some buildings because I'm mad as hell and while we're at it let's a new flat screen TV and some NIKE sneakers. If it's a mistrial we'll get him next time, but all this looting is making me thirsty. Let's burn the liquor store and while they are putting that fire out, let's get some NIKE sneakers.

It doesn't matter what happens in court. Chauvin is already convicted in the mobs mind. They are ready to riot, burn and loot no matter what the outcome. The only difference (depending on the outcome) will be what they are chanting. This trial should have been held mid-winter in northern Minnesota and the verdict announced during a blizzard.

I was a expert witness in a federal court once. When the plaintiff's attorney tried to interject new evidence after cross examination (redirect is the term I believe), the federal judge nearly broke his gavel in half. Well before the defense attorney could objected and the judge, very loudly, reminded the plaintiff's attorney that new evidence was not allowed. One advantage of federal judges is they are not subject to reelection. This is judge Ito moment, no doubt.

Rule 12: The price of a successful attack is a constructive alternative. - Saul Alinsky To solve an issue is to waste it. i.e. a contentious verdict like a mistrial will pour more fuel on the fire while conviction and punishment would tend to support the view that the system works.

MINNEAPOLIS — The fatal police shooting of Daunte Wright and tactics used to respond to people protesting his killing are putting Gov. Tim Walz increasingly at odds with the left flank of his base, threatening to fray Democratic allies heading into the critical 2022 election cycle. A growing number of DFL officials are calling for the first-term governor to reassign the case of former Brooklyn Center police officer Kim Potter, who shot and killed Wright, to Attorney General Keith Ellison. And Walz is facing a backlash for not roundly condemning tear gas and projectiles used in the first nights of protests

BROOKLYN CENTER, Minn. — A forest of little tree air fresheners has grown on a temporary chain link security fence outside the Brooklyn Center Police Department. “A lot of them on there,” Adam Labrie said from across the street. The Minneapolis man, who quietly took in the scene Friday with his two children, sees the air fresheners as a symbol. (Snip) Before he resigned, Brooklyn Center police chief Tim Gannon said Wright was stopped for expired tabs and the air freshener was only noticed later. BROOKLYN CENTER, Minn. — Elected leaders in the Minneapolis suburb where a police officer fatally shot Daunte Wright want officers to scale back their tactics amid nightly protests, leaving some law enforcement called in to assist asking whether the city still wants their help. (Snip) There have been several nights of violent protests and looting of dozens of stores and the police station has also been a focus of attack. Police have driven away protesters with tear gas grenades, rubber bullets, flash-bang grenades and long lines of riot police. Democrat Mayor Mike Elliot, who is black, said at a news conference

Washington state lawmakers passed a bill on Thursday setting a target to stop sales of gasoline-fueled vehicles there beginning in 2030, five years sooner than California. The target is not a firm mandate and is contingent on the state adopting a tax on vehicle miles traveled, a measure to help pay for new transportation infrastructure, according to the text of the bill. The move by the Pacific Northwest state comes as efforts to boost adoption of electric vehicles are accelerating over concerns about fossil fuels' contribution to climate change. Transport is the top source of greenhouse gas emissions in the

BROOKLYN CENTER, Minn —When William Adams moved to this area a few years ago, he joined thousands of Minneapolis residents in transforming Brooklyn Center from the mostly White suburb it once was into one where people of color account for more than half the population. But as he tried to settle into the community, Adams, who is Black, was always reminded of how Brooklyn Center police used to harass him in the early 1970s when he came to visit his girlfriend, who was White. “They would see something hanging in the window, or a light out on my car and

President Joe Biden wants cities to put more apartment buildings and multifamily units, such as converted garages, in areas traditionally zoned for single-family housing. As part of his $2.3 trillion infrastructure plan, cities would allow for smaller lots and for apartment buildings with fewer than six units to be built next to a traditional house. Current zoning laws that favor single-family homes – known as exclusionary zoning – have disproportionately hurt low-income Americans. Many of them can't afford to buy a big lot of land, leaving them trapped in crowded neighborhoods earmarked in the past for Black and brown residents, while white

How did this happen? How did the nation go in an instant from disbelieving every utterance of Donald Trump to robotically repeating — and acting on — every claim that falls out of Joe Biden’s mouth, no matter how disconnected from the truth? The most glaring example involves Biden’s fact-challenged tirade against Georgia’s new voting law. At his first and only press conference, Biden declared the state’s efforts to protect against voter fraud were worse than Jim Crow, “un-American,” “sick,” and “despicable.” (This was the same press conference where moments later Biden bragged about how much time he’s spent with China’s genocidal communist dictator before calling him “a smart, smart guy.”)

Anybody who’s taking Dr. Anthony Fauci seriously probably needs to stop doing so. He endlessly moves the goalposts to maintain his unlimited power over the American people, something Democrats support. That’s why, on Thursday, during House testimony, Rep. Maxine Watters (who is a low-rent harridan) tried to shut down Rep. Jim Jordan’s efforts to get Fauci to say when enough Americans will be vaccinated so that COVID restrictions can end. The past year has shown that Fauci either has no idea what he’s talking about or is trying to advance an agenda that invariably has to do with maintaining the 2020 status quo of lockdowns, isolation, and masks.
