As Donald Trump’s second impeachment trial begins today, not enough attention has been paid to the fact that Chief Justice Roberts will not be presiding.
Senate Democrat Richard Blumenthal, a lawyer, former federal prosecutor and member of the Judiciary Committee, believes the Chief Justice should preside.
Elizabeth Warren adopts the far more aggressive position that the Chief Justice must preside as part of “his constitutional duty.” For good measure, she adds, “I can’t imagine why a Supreme Court justice would not do his duty.” Senate Majority Leader Chuck Schumer presents yet a third constitutional argument. He claims that the Constitution commits the decision as a matter of choice

There's no authority in the constitution to impeach so it begs the question: What will they do to the Bill of Rights after they stack the SCOUS?

The writer assumes, wrongly I might add, that Roberts gives a damn about the Constitution. Proof? If he did care a whit, he would have condemned the House for starting this fiasco and the Senate for allowing such garbage on its floor.

Chief Social Justice Warrior Roberts will not preside over the second impeachment of Donald John Roberts because he is terrified. There are no good outcomes, from his point of view. No matter how he rules, he risks his life and the life of his family. That much, at least, is crystal clear. He is the recipient of credible threats.

Its my belief that if Chief justice John Roberts had the intestinal fortitude to do what is right he would have stepped in as multiple states worked to steal the election. The fact that he didn't should tell you all you need to know about about the character of the man that stood by and allowed for the first time in American history the theft of election by a person who doesn't even know what day it is. Very shameful Roberts, very shameful.

This is a first for Roberts, even if he is correct....but it is probably because he realizes how bone crazy it is and how, if he presided, he would be laughed at by history. Roberts has never ever done anything that might sully his skirts.

While I do not think highly of Justice Roberts, some of you go too far against him. Justice Roberts has, as this article indicates, refused to partake in this "impeachment trial" because he believes it has no Constitutional basis, but also for the same reason he did not want to hear any cases alleging fraud in the election: he wants to avoid making a decision which appears partisan. Of course, the problem with this is that by doing so he has made a partisan decision, just as he did when he rescued Obamacare.

Even though I found Roberts' tax for mandate slight of hand infuriating, I agree with #11. As CJ of the US Roberts can and should express opinions only when required by his constitutional role. He has wisely kept mum, letting his lack of action speak for itself.

For once in his miserable life, Roberts is right in refusing. I only hope that he's refusing because it's unconstitutional and not because he's a yellow-belly.

I will not dignify Roberts by giving him credit for concern for the Constitution. He has demonstrated time and again that he is not concerned with upholding the Law of the Land. However, he recognizes that being associated with this farce could be precedent setting and lead down a road that will eventually rise up to meet the next man/woman who dares confront the Swamp.

1 They cheat to win elections.

Chief Just-Us Roberts and the rest of the Supreme Joke can't rule on a case if the case is never brought before the court. Its part of the Seperations powers. And the Dems know this. They know the Supreme Joke is powerless if a case isn't brought to the Joke. And if Trump is 'acquitted' then the legal no harm no foul rule takes over and no case can be brought. So the Dems can abuse the Chief Just-US knowing that a case can never be brought before the court and the Dems' little Kangaroo Kourt theatrics accrue devoid of any consequences. A totally unconstitutional act that can never e held accountable and lets the Dems do it over and over. Dems are evil and devious to an extreme and this is just one example of their evil, devious way of gooberning.

Roberts isn't presiding because even he is not that stupid. He can see just where this is going, and he knows his part in it all. He helped commit sedition and treason and he knows that about 75 million voters want his hide right now. He knows this is not constitutional and wants no part of it.

Okay, we can agree that Roberts is making a statement by not presiding. However, there comes a time when a man steps up and does the right thing regardless of the consequences. We are encouraged to respect the members of SCOTUS, but how can you do that when their chief decides it’s better to back away than make it clear what the democrats are doing is unconstitutional. That is not courage. In fact, it is the exact opposite of it. The country is roiling because we see there is very little integrity in our government. We need leadership right now and these fools sit back and twiddle their thumbs with such arrogance and sanctimony. What good are men who willingly ignore injustice when they see it?

Roberts is the worst weasel we could have thrust upon us. Roberts always does the wrong thing, or does nothing. Roberts is a coward, and an idiot. Our only hope is that we can get 5 from the SC without Roberts.

Roberts should resign if he cannot do the job he took an oath to do. He chooses to stay and do the bidding of DS and therefore is selling out his country. Justice Thomas has had credible death threats for years. Patriots who have stood up for justice and/or Trump have endured incredible things like beatings in the street, bankruptcy from legal fees and doxxing. Many of them do not have the means for the type security Justice Roberts can afford.
