Multiple news organizations are reporting that Supreme Court Chief Justice John Roberts will not preside at the upcoming Senate impeachment trial of Donald Trump.(Snip)Instead, Sen. Patrick Leahy, the President pro tempore of the Senate, is expected to preside, the sources said. The Constitution says the chief justice presides when the person facing trial is the current president of the United States, but senators preside in other cases, one source said.(Snip)It is not clear from the reporting if Roberts refused, or was not asked.

FTA: If the news reports are true, and Roberts will not preside, then it is not a legitimate presidential impeachment trial. You can’t have it both ways, saying the former President can be tried as if he’s the President, but then have a constitutionally-authorized trial without the Chief Justice presiding. Sure, Democrats can have a trial, but it’s not a legitimate “impeachment” trial.
Josh Hawley has it right: “There’s only one constitutional process for impeachment and it is of the president, not a president,” said Sen. Josh Hawley (R-Mo.). “It requires the chief justice to preside.”

If it is constitutional, the next time the Republicans are in power they should impeach Barack Obama, Hillary Clinton and Jimmy Carter for good measure. Meanwhile, in California, why stop at Gavin Newsom? Recall Jerry Brown as well!

Would faux news be one of those news organizations reporting on traitor roberts? Did you hear? The left is calling for faux news to be cancelled, shut down, put out of freakin' business. That was quick. Could faux news be classified as useful idiots? Tucker Carlson was on fire tonight. He was riled up that they are in the crosshairs of the enemies, the demons running our country. Why Tuck-tuck-tucker understands why we are upset about the corruption of our elections; he understands why some were so angry they stormed the Capitol. He understands now because the leftists are accusing faux news of helping foment the anger based on the President's lies about FRAUD! Too late, Tucker. Well, he is the Chief Justice of the US Supreme Court. And this trial is unconstitutional. So duh!!!
Even with all the blackmail stuff the Demon-Rats have on Roberts, they couldn't force him to do something unconstitutional like preside over the impeachment trial of a private citizen!!! Even he is not that evil and stupid. Too bad we can't say the same about 100% of the Demon-Rats in Congress!!!

I believe the Senate can only try current office-holders of any stripe, and the Chief Justice must preside if the office is the President. Period. No current President Trump, no authority to try in the Senate.
Mr. Trump would likely be within his rights to let his attorney respond that he will endeavor to answer appropriately to a proper member of the judiciary, but not to an unconstitutional, partisan hatchet job by Senator Leaky Leahy.
Does the Demolition Party now want to create the public spectacle of physically arresting a 50+% President?

The only power the Senate has during an impeachment trial is removal of the President from office - and that's already been done. Utter waste of time and money (but that's already been done, also - many times over).

Dubya appointed Judas Roberts specifically because he was compromised. Layer upon layer of rats with an air of legitimacy because they bear special titles and work in special buildings, using the populace as they see fit. Not exactly the USA described to us in classrooms years ago, or that generations fought to preserve.

If Juan Roberto had a set, he would show up, call the court to order then dismiss the proceedings after a long harangue on why this move is the dumbest thing the Dems did since the last impeachment. Never mind, The Chief Justice is a Republican appointee - look for him to be hiding under a desk somewhere. Cowardice is what they do.

Roberts knows this is a show trial. He also knows if he is involved, he loses his opportunity to seat in on any case brought to the Supreme Joke of the US. And Roberts knows he can do far more damage to the country from the bench than in the Senate. Roberts is just looking for the best way to advance Just-Us.

Well they can’t have Harris do that partisan dirty work for the Democrats. Because in the end the kangaroo court that the Democrats are intent on setting up is going to be declared as operating to produce an unconstitutional bill of attainder against Trump. So the leftist and liberal Democrats don’t want to put that down and dirty political anchor around the neck of their probable 2024 presidential nominee. If the Democrats drop in Leahy to preside, they selected an old time liberal Democrat hyper-partisan DC career swamp rat lawyer-politician who is near retirement to do their political dirty work. With Leahy two thing are for sure, he will tell the country that he was a prosecutor in small town Vermont and thus knows a “crime” when he sees one, along with the fact that Leahy is sure to preside over one of the most crooked and most partisan Senate trial that has ever occurred.

In reality the democrat communist would really want to mount Trump on a horse with a short rope hanging from a tree limb then whack the horse on the rump. The problem is that would start a war but Pelosi is willing to do it spurred on by her vitriol for Trump. If Roberts would do it the SCOTUS would forever be branded which they already are for not hearing the case of election fraud. The Supreme Court is tittering on just being whimsical and not a serious bench.

If this is correct, it is because he knows is is a unconstitutional farce and he won't be part of it since it will smear his reputation.
These fools in the Senate are just proving that they are fools, and when in this deep and nasty of a hole, they should just put down their shovels.
