COLUMBUS, Ohio—Attorney General Dave Yost on Thursday filed a legal brief with the U.S. Supreme Court opposing a Texas lawsuit’s goal to effectively delay the Electoral College from voting Joe Biden the next U.S. president. Yost, a Columbus Republican, stated in the brief that the Supreme Court lacks authority to order state legislatures in Georgia, Michigan, Pennsylvania and Wisconsin to appoint presidential electors.(Snip)However, while Yost disagreed with Texas’ call to hold up the Electoral College vote on Dec. 14, he encouraged the Supreme Court to rule on whether the election changes made by the states are unconstitutional.

The Supreme Court has the authority to declare the rules determined by state courts and/or state executive officials (including state governors and election officials) to be in violation of the US Constitution, therefore nullifying the validity of presidential electors determined unconstitutionally by elections in that state.
If a particular state wishes to participate in the election of a president, they have the option of having the state legislature select electors using the authority granted to them by the US Constitution.
The states do not have a choice whether or not to follow the US Constitution.

The SC doesn't have to order the state legislators because the Constitution says that the state legislators have plenary power over the selection of electors. So far, every legislative body has chosen to use the results of the state-wide election but if the SC declares the elections to be illegal, the legislators have to find another method.

What is wrong with these Ohio Republicans? I live here and can’t tell you other than they are never Trumper Rinos. Ohioans are frustrated and furious with Columbus. There is huge support for President Trump in the state. Of course, the big cities are the problem. They tend to go left but the rest of the state is very pro-Trump. We are tired of voting for Republicans only to have them betray us. This time around is especially disgusting because there is so much at stake. I could not loathe these traitors more.

If unconstitutional, what is the remedy? The legislatures of the various states delegated responsibilities (but not authorities) to election boards. Its up to the states to deliver properly selected electors. If they cannot, then they need to stand down,

Many of us Ohioans have had with the gutless wonder we have for a gov. Some of us were hoping Yost would run for governor. Not any more. He is so wrong on this and never should have made this statement. But one thing is for sure, because of this statement, he has lost a lot of support. I only hope the local CVR does not end up supporting him. (local republican club)
