A California district attorney is requiring her prosecutors to consider looters’ “needs” when weighing criminal charges against them.
The new mandate, set forth by Contra Costa District Attorney Diane Becton, makes it tougher to prosecute looting cases in the county, which sits just outside San Francisco.
Investigators must now consider “was this theft offense substantially motivated by the state of emergency, or simply a theft offense which occurred contemporaneously to the declared state of emergency?” according to the policy reported by local outlet East County Today.
In making that determination, they must also consider five other factors, including “was the theft committed for financial gain or personal need?”

In Contra Costa County, can the same considerations be applied to any burglary or robbery? Hey, Judge, I robbed that bank because I have all these college loans to pay back, you see. Or, hey, Your Honor, I burgled that house because I have a bunch of baby mamas and their babies to support. And, you see Judge, my television is one of those old-fashined heavy son-of-a-guns and I really NEEDED that 60 inch flatscreen.

When lawlessness is permitted, it festers and grows.
Looks like this DA, and maybe others, were looking for some wiggle-room on a lot of cases, so they decided to make up this rationalization, justification, or excuse.
