In their latest bid to end a protracted legal fight immediately, retired Lt. Gen. Michael Flynn’s lawyer and the Justice Department argued on Tuesday that the presiding judge in the former Trump national security adviser's case had the appearance of bias.
Sidney Powell, the former federal prosecutor who took over Flynn’s legal defense last year, and acting Solicitor General Jeff Wall, representing the Justice Department in court following its move to toss the false statements charge against Flynn, clashed with Judge Emmet Sullivan’s attorney, Beth Wilkinson, during a four-hour hearing before 10 skeptical judges on the U.S. Court of Appeals for the District of Columbia.
The US Constitution and the rule of law continues to be ignored by a judiciary that rules over us like we are surfs, and not free people endowed by our Creator with unalienable rights. Is it time to join with Antifa and burn down some corrupt court houses?

Judge Thomas Griffith, a George W. Bush appointee, suggested Tuesday that the Flynn case might be “in the wheelhouse” of “favoritism for a politically powerful defendant” and that “one of the purposes” of Sullivan holding a hearing might be to ask about that.
Politically powerful? Sullivan helped the Marxists destroy Flynn's life over now proven made up evidence against Flynn. The en banc is going to keep Flynn's life destroyed and ensure the actual criminals who ARE the real "politically powerful" felons get away with their crimes. Up is down, down is up. Good is evil and evil is good. Get used to it. Don't be surprised if Biden wins, Flynn goes to prison, the day after Kamala is inaugurated.

So, if the Wilkerson/Sullivan wins, who will be the new prosecutor? Do the winners go find a democrat prosecutor to retry the case in front of a democrat judge?

This is the kind of thing that absolutely enrages me. It feels like justice has been hi-jacked by the democrat party and the rest of us have no legal recourse. There is always an activist judge somewhere who will side with the lawless democrats. I cannot believe the audacity of this action against Gen. Flynn. More than anything this is an indictment of the bias of the judiciary. My heart is heavy because I fear what is coming next more than what has already transpired and that is that the cabal who conspired to commit sedition will get a slap on the wrist, if that. If that is the case, it will do more to suppress Republican voters from coming to the polls because it will be a clear indication that the country has been lost to a bunch of anti-American zealot Marxists. God help us and that is a sincere plea, not words thrown out there in frustration.

The DOJ withheld important information on this frame up until just recently. At that point the Attorney General had the materials reviewed and sent 'enough to warrant a dismissal'. He did not send everything. He admitted recently there is more that is being withheld.
AG Barr is still holding a hole card on this case. It is something that is going to get someone indicted. But, he is not ready to
show all his cards.

Democrat politics have been creeping into the federal judiciary for approximately 30 years. This pollution was greatly accelerated by corrupt Obama. Donald Trump is doing a good job of turning this around. It's imperative that Trump be reelected to continue draining the swamp, which includes the Obama judges in the federal courts. Bill Clinton was an amateur court packer compared to Obama. Biden would be as bad as Obama regarding recommending federal judges, and "Heels Up" Harris would be worse than Obama.

Its imperative that President Trump place more judges in the lower courts, as well as Supreme Court justices on the bench. These lower courts are so corrupt that they force cases up to the Supreme court. Democrats want a country run by corrupt judges, when they cannot get their bad legislation into law!

Well a majority of the DC Circuit Court consists of liberal Democrat judges who you can safely bet will stick together in any politically charged case, like the Flynn case; while the minority consisting of Republican nominated judges can go either way, with any Bush nominated judges always being a “wild card” prone to stupidly side with the liberals as we have recently seen since President Trump smoked them out.
Chances are since the Democrat political objective is clearly to have the case slow walked past the November election that the Circuit Court Majority, maybe with the help of a couple of Republican nominated judges will send the case back down to Judge Sullivan to see what he will do. No doubt once Sullivan gets the case back that he will hold a series of hearings, even appointing his own prosecutor, and in the end will rule against Flynn. All that will take a lot of time. Following that there is no doubt that Flynn will appeal Sullivan’s adverse decision back to the Circuit Court where it will be put on the appeals court calendar, probably for some date after the election. If that scenario happens will anyone who has been paying attention still believe that the Federal Courts are on the up and up and are not clearly politicized anytime a politically charged case comes before those courts?

The DOJ drops this and these rogue judges think what? They will try the case and just become the prosecution, defense, jury and executioners themselves? Sullivan should be thrown off the bench and disbarred. He is not qualified or authorized to decide the role everyone will play here. Nor is he fit. He is a disgrace and should be treated like one. The idea that Flynn is getting off because he’s powerful is laughable. Explain Hillary Clinton.

For those with half a mind...The Department of Justice is NOT about justice. If you think, as I do, that Flynn was set up, the simplest thing for DOJ to do would be to declare him innocent of all charges, but it does not.
The question is what is being swept under a rug here? Judge Sullivan was gifted a two year farce that had the full participation of Flynn and DOJ. And now he has no right to get to the bottom of this affair that features crooked cops, crooked lawyers, perjured guility pleas, and who knows what else? What is it that everyone is afraid to expose? Let's get the whole thing out on the table.

this matter should not even be where it is. judicial prejudice and other assorted illegal / legal moves prove how corrupt and bankrupt the federal judicial system really is. thank you barry soetoro / bush the younger & bill clinton. you have taken monumental steps to bring about the weakening of the best form of government to ever exist on the face of the earth.

The DC Circuit Court also appears to be biased, else they would have spent only a few seconds deciding the obvious, that the Flynn case is over.

Let's step back for a moment and look at this through Sullivan's eyes... he's frightened by something or someone....all those years as a judge must mean he follows the law.... so... what happened now?...my thinking is someone has something incrementing on him or his family members.....the lefties in DC are terrified of General Flynn... why?

Aside from the FBI and DOJ injustices against General Flynn, this case again points out one of the reasons I dislike lawyers in general. Note that NO ONE brings up the fact that this is costing the American taxpayer millions of dollars. Lawyers and law schools have convinced the public that no amount of money spent on a trial can replace the process of getting to the bottom of a case and seeing that justice is done. This scam has been the secret to wealthy lawyers for years and years, and the judges, all of whom are lawyers, are in on it. Meanwhile, the good old tax-paying citizen essentially is told to bend over and enjoy the assault on him and his wallet.

I’m thinking then that poster #17 above does not like Democrat politicians, as almost everyone of those Democrat politicians is also a lawyer. Both Biden and Harris are lawyers. The last two Democrat Presidents, Obama and Clinton, plus both their wives were all lawyers. On the other side of that coin, none of the modern era Republican Presidents since Ford were lawyers.
