A group of 22 media organizations, publishers and professional associations joined a brief filed last week in support of Oberlin College in its ongoing appeal of the multimillion-dollar legal judgment awarded last year to the Gibson family and Gibson's Bakery in Oberlin.(Snip)The organizations signed on to the amicus brief, written by attorney Melissa Bertke of the Cleveland division of the law firm Baker Hostetler, in support of Oberlin College. An amicus brief is named for the term "amicus curiae," which is Latin for "friend of the court" and a legal practice when a person or organization that has a strong interest in the outcome of the case,

Of all those groups mentioned that signed on, the only one I ever heard of was the Akron Beacon Journal, which I delivered as a kid. Do those other outfits even exist?

I cannot believe it helped Oberlin's case re: no malice when they cancelled l-o-n-gstanding contracts for Gibson's baked goods used in the college food service operation.

All probably represented or encouraged to file by the lawyers for Oberlin (remember their trick to use their client, a Cleveland TV station that never covered the trial to have the court release evidence from a witness never called at trial, one of the Gibsons, because they thought he had made a racially-insensitive Facebook post.).

Oberlin College is not a bookstore, newspaper, or other type of media outlet. They were an active participant in the defamation of Gibson's Bakery. No amount of verbal or linguistic gymnastics will change that.

Key point: Oberlin College produced no evidence at trial that the protesters' claims were legitimate. Frankly, I don't think they cared, one way or the other. They were interested in perception. They knew that OC had a longstanding relationship with Gibson's and were afraid that if they didn't take the side of the students, they would lose tuition money, plain and simple. They're trying to draw this out until all of the Gibson Bakery heirs have passed away. Hopefully the millions that the jury awarded the Gibsons will still get to them. The whole appeal is absolutely shameful.

Maybe the Media Idiots need to have their Press Privileges revoked as they don't know the difference between legal and ILLEGAL actions!

Given the origin of this entire case and what is currently happening in demonrat run cities and states, we can now say without a doubt that “free speech” now includes shoplifting, looting, arson, assault and murder.

The jury had been instructed by the judge to review the legal standard “actual malice” when determining the intent of the college, its vice president, and dean of students. The college argues they “were REDISTRIBUTING the speech at issue in this case.” Ohio law mandates a court or jury must find REDISTRIBUTION of literature or other materials are liable for defamation only if they act with actual malice. Jurors found unanimously the defendants acted with actual malice “when publishing the alleged defamatory statements against the Gibsons plus inflicted emotional distress on David Gibson and ‘Grandpa’ Gibson.” Liberal media circling the wagons?
