From the beginning of the Michael Flynn case, Judge Sullivan has been hostile to Flynn. By December 2018, based upon a misreading of the facts, Sullivan accused Flynn of conduct amounting to treason and said that he felt “disdain” and “disgust” for what he believed Flynn had done.
Sullivan’s behavior, however, went from hostile to bizarre when the Department of Justice, having uncovered massive wrongdoing the FBI’s and DOJ’s handling of the Flynn matter, moved to dismiss the case. On Saturday, though, Judge Sullivan managed to escalate from bizarre to . . . well, maybe paranoid is the correct word.

The judge is a swamp creature who needs step down from the Flynn case and retire into oblivion.

What is going on here!!! He is being blatant and defiant. I don't get it. Did someone get to him? I believe that after this, he needs to step down or be removed. Something is not right about the entire thing.

Very insightful. If correct, this also bodes well for Flynn's damage suits. He has the Executive branch, DOJ and FBI and intelligence and others acting illegally against him. He has the Judicial branch, Sullivan's court acting "illegally" against him. There were certainly statements by Congress critters against him. By all rights, that is governmental damage on an unprecedented scale. Flynn should be awarded $10 billion in damages and he could call it square.
I could also wonder if Sullivan is SO incensed against Flynn and against this action that he can't trust himself not to explode against the appellate court, thereby embarrassing and condemning himself, so he is placing a layer of distance with legal representation between himself and the appellate court.
Is this also just a stalling technique because Sullivan wants Flynn twisting in the wind longer? It is classic that lawyers demand more time to "prepare" the case for their client. Hopefully the appellate court will remember this is NOT a case. This is a procedural work issue. It's nothing more than hiring a painter to paint your house, finding he missed a section, and calling him in to complete the job correctly.
Then again, maybe this is purely a political stall and Sullivan has his marching orders to sabotage the dismissal by any means necessary. Did BO have a little chat with Sullivan? Or is Sullivan such a political animal that he is following this path on his own initiatives, which is a violation of impartiality.

Sullivan’s use of a lawyer raises question of whether he is warning the 3 judge panel that he will appeal a decision to remove him from the Flynn case to the entire Circuit. And if the entire appeals court rules against him, he’ll take their decision to the Supreme Court? This process would take case close to November election, with his lawyer, Beth Wilkinson and wife of David Gregory of NBC, turning Sullivan into a crusader against Trump’s vicious DoJ.
Lost in all this are: Flynn’s life remains in legal limbo; his legal expenses continue; he has to remain silent rather than speak out; the fact that the FBI withheld all exculpatory documents for 3 years goes unpunished; and that Flynn was entrapped by Obama and Comey goes unmentioned. Judge Sullivan is a clever Swamp Rat.

There are two very insightful comments following this article that may very well explain the judge's actions. It has to do with what Gen. Flynn knows about Obama, Iran, arms deals and money laundering, all of which has to be kept from coming out until after the election. Both are worth reading in full.

They are reporting that the Judge has now hired a “high powered” attorney to represent him in the Flynn case. No doubt he did that to further delay the matter. His new lawyer will now probably file a motion with the Appeals Court asking that the matter be delayed until she has an opportunity to review the entire case, probably for months. Anyone still think that the federal courts have not been politicized anytime a politically charges case comes before those courts?

This controversy has little to do with Michael Flynn. Sullivan has a man-crush (is that correct given Obama's leaning?) on Barack Obama and is siding with his crush. He achieved his 15 minutes and is now clueless how to back out of a mess of his own creation.

From my reading elsewhere, it looks as though this judge's strings are being pulled by others. Seems to be something in his college background being held over his head maybe. This judge has no interests to defend, but he hired an attorney anyway. Anything to drag it out. Anyone who votes democrat this year is as bad as the democrats themselves.

Just more evidence that Obama didn’t need Hillary for his 3rd term: he has most of the federal government still working for him. Oaths of office, the Constitution and federal laws mean little to these worshippers of Obama. These worshippers make all their decisions along leftist and/or racial lines, and we are poorer for it. Add in the leftist media, academia, the tech sector and Hollywood, and Obama reigns.
Forgive 2nd post, but Trump has to be admired for accomplishing so much against this diabolical coalition.

One hires a high priced defense lawyer when one has something to hide. Given the history of Gen Flynn's first legal team who greased the skids for him to a guilty plea, one wonders whether they and Judge Sullivan are part of the same cabal? Was this a case of the swamp arranging the lawyers and the hanging judge to ensure that Gen Flynn never had a chance?

The circuit court doesn't have to accept the lawyer, they wanted to hear from the judge himself. Sullivan has just made a huge fool of himself pulling this. Of course, it might not be his decision.
In any event, the circuit court could tell Sullivan, all right, so your response is that you have no response since you hired a lawyer, so you are ordered to dismiss the case and retire. That would be a publicly humiliating event.

When a judge goes against all reason and case law to force a desired result, I have to suspect blackmail or bribery. John Roberts comes to mind, as well.
Those who refuse can end up dead with a pillow over their face.
