It’s amazing that, to this day, neither of Gen. Michael Flynn’s legal teams have been able to obtain the FBI’s 302 from the January 24, 2017 White House ambush interview.

Devin Nunes spoke to Fox News’ Maria Bartiromo about the original report.He said Congress had been briefed on it by FBI sources who said, “’Look, there’s nothing to see here, Flynn wasn’t lying.’ So we knew this at the beginning of 2017, so you can imagine my astonishment when it began to leak out in the press that General Flynn was being busted for lying to the FBI. I expect that a form like the "lost" 302 has a documented line of possession. Identify who had possession of it last and charge them with destroying evidence if they can't produce it.

The really, really, best evidence of Flynn having or not having any motive at all to lie to the FBI about his telephone conversation with the Russian Ambassador is is to be found in the contents of the transcript of the telephone call that was recorded by the FBI, and that was known to the FBI before they covertly interviewed Flynn. That transcript will also show if the FBI had a legitimate reason for interviewing Flynn.
Common sense will tell you that the telephone call between Flynn and the Russian Ambassador was also recorded by the Russian intelligence service. So by reviewing the transcript, the FBI, the CIA, Barack Obama and his crew, and the Russians, know the content of the telephone conversation that Flynn had with the Russian Ambassador.
With all those entities already knowing what Flynn and the Russian Ambassador said to each other, the only people with standing, who have not been told that exact information are the American people. So why not publicly release the transcript of the telephone call. The excuse that such a release would reveal intelligence sources and methods does not hold water, as the Russian intelligence service and the Russian government already know the contents of the telephone call in question.

The issue doesn't appear to be "Team Mueller" holding out but rather President Trump's FBI actions or inactions. The president's largely rhetorical tweet embedded within the article only highlights his apparent lack of control of his administration's primary Executive Branch law enforcement agency, while Director Wray and his minions remain in their positions of authority. The documents in question are subject to Executive Branch retention and archiving requirements under a chain-of-command that ends with POTUS. The article further illustrates too much focus on and actions by the media and not enough focus on government responsibilities under the law with regard to criminal process and procedures.

After a fair trial - - of course. Just like the one Gen. Flynn is still having.

My FBI friend told me two interesting tidbits about 302s last night at dinner.
First, two agents are required on each interview, and BOTH must sign off on the 302 documenting the interview.
Second, for some years, approximately 5 or so, he says that 302s are then put into a online document tracking, storage and retrieval system.
When asked if the online tracking might be "jiggered" he said he didn't doubt that they might be able to do that, even though it wasn't supposed to be possible.

So, it was a news story that led LTG (ret.) Flynn to surrender...
Whatever. Go pound on Barr to have his attorney's rewrite the latest memo for dismissal to read that Flynn did nothing wrong, and was wrongfully accused, extorted by the US Government. Instead DOJ tells the judge that the reason for requesting dismissal is because they don't feel they can make a case to prove guilt beyond a reasonable doubt. Go read the motion...
