I want to give a “hat tip” to a person who inhabits the comments at Patterico under the moniker “Sammy Finkleman”. (Snip)
Two days ago he posted a comment (No. 32) in which he included an excerpt from the transcript of the first sentencing hearing in the Flynn case before Judge Emmet Sullivan, (Snip) set off alarm bells in my head based on my experiences in having taken maybe 1000 guilty pleas in my time(Snip)
The Dec. 18 hearing was where Judge Sullivan made the infamous “suggestion” — via asking the prosecutor if the issue had been examined — that maybe Gen. Flynn might have committed treason.

I’m no lawyer (can barely spell it), but his Grace, Emmet Sullivan, Esq. of the High Court, seems a bozo.

This Judge needs to be fired. He sat on the bench for this entire case and still doesn't get it? Most likely he's Obama's puppet trying to sway the DOJ to do a different approach on Gen. Flynn, and now that the DOJ has dropped it, he's moved on to employ third-party Demonrats to pick up the ball to further destroy Gen. Flynn.. At some point the Chief Justice Roberts needs to send this buffoon Judge a short memo to advise him that he's already stepped into the zone of Judicial malfeasance.

Kudos to the author. He found the little crack in the wall that brings the entire thing to a crumbled mess. I said before, generally speaking, once a judge accepts a guilty plea the course of the case is no longer in the hands of the attorneys, the judge now completely owns it. He can even deny the withdrawal of a plea if he has established the key elements as the author points out. I've spent a ton of time in the courtroom over the past 30 years, but that one slipped by me. Good job.

Judge Emmett Sullivan is the poster child for the "Obama Judge" theory. True, he was originally appointed by Ronald Reagan ,and elevated further by both Bush, and Clinton, but he has made his political stance very clear with this case. That Judge Sullivan refuses to view the irrefutable evidence clearing Michael Flynn and is now considering perjury charges for wanting to change his plea is a clear indicator that he is just another political hack who is out to prosecute anybody associated with President Trump.

Biased AND incompetent - Wow! - Sullivan is a double dipping judicial twit. It is interesting to watch this jurist doubling down on stupid. If we only had the House he could be impeached because Roberts will never do HIS job and discipline this judge.

General Flynn has more honor and integrity in his little toe than Judge Sullivan has in his whole body, including the added bodies of all the corrupt government criminals!
Sullivan needs to be gone! He is obviously too partisan to uphold the law and the Constitution, and I'm thinking that he doesn't even know, or understand, either!

Does anyone seriously think the nut judge will recognize his error and back down? If so, where have you been since the curse of the Clintons began? Rules don't apply to these evil people, and if you try to make Sullivan abide by the rules of the system, you're racist, so don't hold your breath waiting.

Okay, then, take to appeals, get Flynn off...but you've got to have something to appeal, and that hasn't happened yet. Let's stop and think about this a second...Flynn is charged with a crime...he hires a crackerjack law firm...the FBI/DOJ squeeze him with threats to prosecute his son if he doesn't cop a plea...Flynn's legal team negotiates the terms...eventually he signs a guilty plea admitting his crime and claiming it is being done of his free will, no pressure...Sentencing is delayed so that Flynn's promised cooperation can be considered...FBI caught doing a dirty...DOJ backs off, requesting dismissal on the basis that it cannot prove guilt beyond a reasonable doubt under the circumstances - and that is NOT EXONERATION. Both DOJ and Flynn have left the judge in a difficult situation after playing their games in his court for years. This is his way out. To expose the whole mess for what it is. Ms Powell should be THRILLED for the opportunity to represent Flynn in this matter. But the matter is NOT whether or not DOJ and the FBI played dirty...it's whether Flynn told the truth to the court in making his plea under oath. If he didn't, there's very likely a perjury charge in his future.

Does the fact that Flynn plead guilty, even though he knows he isn't, because the prosecutors threatened to go after his kid if he didn't, enter into this equation?

Sullivan personifies the liberal philosophy that manipulates, preverts and distorts language to suit its purposes. Without a common language of agreed definitions and terms. there can be no negotiations, no justice, no law.. The first thing that people in bad faith do is quibble over words. "It depends on the meaning of the word IS".
Sullivan is clearly a bad actor. He needs to go. If we can't do better than Sullivan we're better off not having a federal judiciary.

Much has been written about Reagan & Bush appointing Sullivan. Yes, it's true that Reagan appointed Sullivan to the DC Superior Ct in 1984. And it's true that GHW Bush appointed Sullivan to the DC Ct of Appeals in 1992. But those are really low-level courts, similar to local municipal and state supreme cts, respectively.
Sullivan gained real power when Clinton appointed him to the US District Ct for DC in 1994. That's an important federal district court.
