Ex-National Security Adviser Michael Flynn’s war with the government isn’t over just yet. He scored a decisive win, with the Department of Justice filing a motion to dismiss the bogus “lying to the FBI” charges against him. Charges that were politically motivated, part of an elaborate and expansive FBI plot to entrap the former top Trump official. James Comey and Andrew McCabe were out to get Flynn no matter the cost. Department policy and the Constitution be damned; they were going to him. Flynn was the target of the FBI’s counterintelligence probe into Russian collusion because he spoke with the Russians…because that’s what incoming national security advisers do.
There are many people who have been coerced by a prosecutor to stand in court and lie with a "guilty" plea, in order to reduce their penalty or future risk. Now they can be charged by that prosecutor with perjury?!
I hope Flynn gets his old job back in the white house and exposes exactly what they were terrified he would.

If Flynn is charged with perjury for copping a plea to save his family, then not only should his original Covington & Burling attorneys be charged with suborning perjury, but so should the prosecutors and higher-ups in the DOJ who pushed the whole farce of a case.

How is this not a case of double jeopardy? No resources to pay for a trial, so he takes a plea deal. Now he's threatened with perjury for taking the plea. This is not justice, it's tyranny.

This situation has been outrageous from the beginning. I see that the President is attempting to allow the system to work but the system is broken. Pardon Flynn, compensate him for what he has lost and send that inept Obama judge packing. The former fake president is crooked and disgraced, the FBI is corrupt and democrats will howl. Those conditions will not change anytime soon.

Now that we know you were blackmailed into pleading guilty when in fact you were not, but hey buddy you still lied to the court so I'm gonna have to do what I have to do.
Hey I have an idea. Let's create a position, put people in charge of exercising judgement for situations like this to sort out between technicalities and justice we can call them.... let's see....Judges, yea that it, Judges.

The Kenyan Lightbringer clearly said Flynn was guilty of perjury in his 'speech'. Maybe he spoke too soon or was giving instructions to the judge.

Imagine if a Democrat President was having the DoJ and FBI investigating all of Obama’s scandals, but Obama as a Republican. There would be dozens of Republican cabinet officers and other officials in prison or awaiting sentencing within 12 months of the Dem’s inauguration, no matter how flimsy or contrived the evidence. Instead, we have a Republican administration, in almost 4 years, seemingly unable to even issue indictments of the most incredibly well documented lawbreakers in our history. Yet the Republicans regard themselves as law and order types while the Dems mouth the liberal nonsense of not having a police state.
If Judge Sullivan is not rebuked by an appeals court for attempting to undermine AG Barr and the rule of law, we’ll have confirmation that the federal bureaucracy, including the courts, are simply an extension of the DNC. Also more proof that Chief Justice Roberts badly misled us when he said that there are no Obama judges versus Trump judges.

The two-tier justice system now extends to the level of Federal judges. Eric Holder's filing to correct prosecutorial misconduct in the Ted Stevens case is granted immediately by Judge Sullivan, while Bill Barr's filing to correct prosecutorial misconduct in the Michael Flynn case is blocked immediately by Judge Sullivan. Regrettably, political bias is now firmly established in the judiciary branch.

Both Ms Powell and the DOJ should move to reassign this case to another judge who will follow the law. NOW.
Let the old crazy judge hit Flynn with a contempt charge or something like that. Then Pres. Trump can pardon him on that charge.

Far from ridiculous. Flynn has a recurring problem with the truth.
For starters, Flynn was judged by Mike Pence to have lied to him when asked about this case at the beginning. That resulted in PDT requesting Flynn's resignation. (If Mike Pence is having second thoughts, his judgement is then fairly in question.)
Flynn swore TWICE to the court that he was guilty of the crime charged. One can argue there was no crime...begging the question to what was he PLEADING GUILTY. One can say he was being coerced by the FBI, protecting his son from prosecution. Flynn apparently commissioned his attorneys to work out the deal for his plea and future cooperation. Guess he didn't care to defend himself and his innocence.
Flynn SWORE to the court that 1) He committed a crime, and 2) That he entered his plea freely, without pressure to do so. There's the hook. One statement may not be true, the other is the basis for withdrawing the plea, allowing the case to be dismissed.
Courts don't like being lied to. Try it sometime, and see what happens if caught. The rules allow heavy penalties for wasting the court's time with false claims and issues. And that is what Flynn is facing now. He could have had a trial, and he instead falsely entered a plea under oath...which he now argues was false and coerced.
It will be interesting to watch Ms. Powell spin that...

Worst case of Judicial Activism ever witnessed in the American Courts. I would hope the Supreme Court would send a memo to this clown Judge telling him to cease and desist before he risks his seat on the bench.

I can hardly believe this happening. What happened to my country? The hubris of Judge Sullivan to call for an Amicus Brief when BOTH the defense and prosecution are in agreement to a dismissal is outrageous. We have been calling Washington a swamp but that is way too benign a description, it is the home base of a crime syndicate. Apparently, Justice is anything that the democrats say it is. It is frightening to watch the system treat this fine man, a Three Star General, as if he were the biggest threat to the Republic since Benedict Arnold while known criminals walk free. Where are those indictments?
Each day that passes reveals another lawless outrage committed by the Obama cabal. For three long years it has been a battle for the truth. Finally, we are seeing exactly who committed the crimes that have been contributed to the President. Not only are these lawless criminals willing to knowingly pursue an innocent man, they are engaged in an effort to destroy any hope of justice in this putrid town. In plain sight and with the support of the media, these lawless rogues confidently push on in their obsession to pervert justice. This tactic being used against General Flynn is especially egregious. As Americans watch our system of justice being destroyed by lawless miscreants while most legal scholars who claim to revere the Constitution and rule of law remain silent, our faith in the system hangs by a thread. We cannot allow this continued assault and hope to retain trust in the system. When trust is destroyed, why obey the law when you know justice is going to be perverted? Lost along the way is the silent agreement between we the people and the judiciary that justice would be fairly administered to everyone. It appears the government has breached that sacred contract.

Both the prosecution and defense are in agreement that the charges be dropped. Sullivan is being purely political. Have to wonder what he has to hide.

I hope Flynn has already or will sue Covington and Burling (and their member Eric Holder) over the fine legal "representation" they gave him. A whole new meaning of malpractice and unethical conduct here where your own attorney colludes with the government to prevent discovery of the facts by their own client. BEYOND OUTRAGEOUS. Wherever these clowns are licensed the Bar/state board needs to pull their ticket. ACCOUNTABILITY!!!

Admittedly, I was skeptical at first that Sullivan would attempt to trip up Barr’s scheme, which amounts to extending a pardon to Flynn without the trouble of a proper presidential pardon (and the political blowback that would accompany it). However, I am reminded that life-long appointees to the federal bench enjoy tremendous independence and discretion. When wielded in the interests of justice to prohibit corruption of the court processes, those powers become a substantial impediment to an executive branch with autocratic pretensions and contempt for the rule of law.

Is this even LEGAL?? The prosecution presents evidence AGAINST the defendant, the defense presents evidence FOR the defendant and the judge "impartially" decides. What is the role of the judge in this sideshow?!

The "Prosecution" even had an "off the books" agreement, yet that does not capture the attention of the judge. What a crook. Hopefully, it is Fokker to the rescue to close this out once and for all.

This judge is clearly a political hack and is out of bounds. He needs to be removed from the bench. He is allowing the judiciary to be used as a political weapon to appease his corrupt cronies in the FBI. He’s not even trying to be clever about it. It an outright blatant violation. Move this out of his kangaroo court and open an appeal.

You would have to be of the moron class to continue to believe that the Federal Courts have not become politicized, and today are not essentially just “Kangaroo Courts” anytime a politically charged matter comes before those courts. Here we have Barack Obama, in obviously deliberately leaked remarks, just the other day falsely claiming that General Flynn was convicted of perjury, when he was not. Now today the Judge Sullivan pops up and remarks that he is considering lodging a new charge of perjury against Flynn! Just a coincidence?

#15 - The issue before Sullivan is the the 2x guilty plea Flynn made under oath, not the charges originally brought and requested dismissed. That is not within the purview of DOJ. The sworn statements that Flynn made, particularly that he was indeed guilty and made the declaration freely, with out pressure, was made to the court. It is a question of perjury before the bench, not lying to the FBI. Ms Powell should be licking her chops...

#12/15, a defendant is allowed to try to withdraw a guilty plea. It would be novel indeed, if doing so could subject him to a charge of perjury. New information came to light recently that indicated the FBI didn't really have an underlying case they were investigating when they interviewed Flynn. The Logan Act? Get real. And the initial conclusion was that Flynn didn't do anything wrong in talking to the Russian ambassador. After the higher ups reversed that, Flynn was set up to see if they could get him to lie. They already knew the truth, since the call had been unmasked. What possible purpose did they have to interview him other than getting him to lie? If he had known all of this when he entered his guilty plea, would he have done so? Lying is not a crime. Even lying to the FBI is not crime unless it affects an underlying investigation of criminal acts. His guilty plea was entered before he knew the exonerating facts. Sorry if the federal judge doesn't like lying. He still has to show all of the elements of perjury, which do not appear to be met here.

I really thought the judge would be outraged with the Obama WH & JD when the names were revealed that unmasked Flynn. So the judge has made a new rule, request your guilty plea be withdrawn & expect a perjury charge??? Unbelievable!
