The Department of Justice, after concluding that the prosecution of Michael Flynn was the product of misconduct by FBI and DOJ officials, moved to drop the case against Flynn.(Snip)A judge has discretion whether to allow a case to be dropped, but normally if the prosecution doesn’t want to prosecute, a judge will not force a prosecution. But where a guilty plea has been entered and accepted by the court, and a motion to withdraw the plea rejected by the court, the court has a lot more power because the prosecution, in a sense, is over already. Only sentencing remains.

I suggest we look into the Judge's own motivations. Something smells. And it isn't justice.

If the judge has expressed 'disdain' for the defendant, perhaps he should recuse himself? On the other hand.... General Flynn did plead guilty under oath at least once saying that he did the crime, thus raising the question of perjury before the court. TIs a mess worthy of a Supreme Court pleading.

It's possible the judge will entertain arguments for a dismissal, but the correct "paperwork" must be generated for the court to consider it.

Sure he pleaded guilty . That is not the issue. If the investigators should have not been in his face, his crime, however it happened, however he pleaded, is irrelevant. Prosecution has to toe the line on rules.

LTG Flynn did *not* plead guilty to perjury! His guilty plea was for lying to federal agents. He was not under oath. Big, big difference.

At some point, Sullivan told Flynn “arguably you sold your country out.” That shows how biased Sullivan is - Flynn didn't plead guilty to treason or bribery, he plead guilty to one count of lying to the FBI. Big difference. Lying to the FBI (if indeed he did) is not selling out the country. It is a process crime that requires consciousness of lying which Flynn did not exhibit.

They are busying themselves with the Fb clickbait lure of “Wish President Trump Happy Birthday” but of course, to sign the card requires giving your info and making a donation to the NRSC. Good ole Nikki Hailey also using Trump to generate money for HER group supposedly to fight Communist China. As Professor Jacobson has written, the judge “may feel there is political manipulation going on and prefer to force a Trump pardon rather than let Flynn off the hook himself.” According to the article, the judge has “expressed his disdain for Flynn” so may want to force President Trump to pardon him. Whatever is going on, for whatever reason(s), Mike Flynn and his family continue to be subjected to emotional turbulence that is heart-wrenching.
