The Supreme Court unanimously upheld a federal statute that forbids encouraging illegal aliens to remain in the U.S. unlawfully in a decision Thursday.
The Supreme Court justices voided an earlier decision by the Ninth Circuit Court of Appeals, which had ruled that a federal anti-harboring statute was unconstitutional on the grounds that it violated the First Amendment by restricting free speech. The ruling by the nation’s highest court Thursday upholds the law.
The Supreme Court not only vacated the appeals court’s decision but also criticized the judges for “drastically” straying from judicial norms.

This seems to me to make sanctuary cities and states illegal. Pretty obvious to me. So when do the prosecutions start?

This is only a bombshell to the AOCs of the world. It's common sense to the rest of us. The biggest surprise to me was not so much RGB writing the opinion, but that the 'wise' Latina agreed with it.

Well not really a bombshell since the decision was not about the subject matter but instead to send the case back to lower courts based on the fact that the argument was not made by the defendant but by third parties. So technically a technicality.

Sorry- but this decision only stands for the proposition that a court cannot consider matters outside the record presented by the parties to litigation. It will be sent back to the 9th Circuit to be reconsidered based only on the record-where the Ninth circuit will undoubtedly find the same result it did the first time. When it comes back there is no way in the world Ginsberg and Sotomayor will vote to reverse.

I think what they did here is send the case back to the Ninth Circuit for reconsideration, because its ruling was not based on legal arguments that the litigating lawyers had actually made. So if I understand this, it might be too soon to celebrate, because when the Ninth reconsiders, it could still rule the same way, but use different reasoning.

OK, but the BIG QUESTION remains. Will this ruling that "encouraging" illegal immigrants to stay in US is illegal play any role in making sanctuary cities, states, counties ILLEGAL? They do MORE than "encourage"; they "facilitate"!

#10 sanctuary cities are already illegal. What would get thrashed out in the courts is whether Trump can yank their federal funding over it He could send the National Guard into these cities and forcibly remove illegal immigrants and not many people outside the left and right coasts would complain. I think he just doesn't want to face the barrage of women/children sob stories. It would be epic.

The headline here is deceptive. I read the entire opinion, as well as the Ninth Circuit opinion, available online. I agree with comments #8 and #9. There's less here than meets the eye.

I see this as huge because it narrows the scope of evidence and arguments the courts can accept. If third parties’ arguments can be used, the standards of decision devolves into chaos. I think the 5 liberal judges recognized that if they allowed a new legal standard with the volume of new, conservative judges being appointed, the left’s legislation by blacked robed demigods would rapidly be reversed.

Forcing the circuit court to consider the defendant's First Amendment argument is important, because there is no constitutional right to advise someone to break the law. That is why the Ninth Circuit avoided the argument in the first place.

The reason that the leftist and liberal Democrats created the so-called Sanctuary Cities concept was to encourage illegal aliens to stay in the USA, in those Sanctuary Cities, where those local politicians cooperate with all sort of individuals and entities whose purpose is to undermine the enforcement of the immigration laws. What the Federal Government should do is select some very egregious local politicians who have been encouraging illegal aliens to stay in Sanctuary Cities and prosecute them.
