President Trump said 3M “will have a big price to pay” after he ordered the manufacturing giant to churn out more protective face masks for the coronavirus fight. Trump invoked the Defense Production Act to get more N95 respirators from the Minnesota-based company “after seeing what they were doing with their masks,” he tweeted Thursday evening. Health care workers have been grappling with a shortage of the masks that filter out airborne particles. “Big surprise to many in government as to what they were doing–will have a big price to pay!” the president tweeted. Trump’s tweet did not elaborate on the government’s concerns

From what I’ve heard the Obamacare bill put in a medical devices tax to help pay for OCare. These face masks, in made in the US are subject to the tax. That’s why 3M has moved most of its medical device manufacturing out of the country. Notice the article says they manufacture globally. Now we know why.

If I were 3M I'd see you in court, Mr. President. The Defense Production Act of 1950 as amended does not apply under these circumstances. Your order is worthless and unenforceable. Have a nice day.

I heard the director of the FL equivalent of FEMA saying that he was unable to purchase masks from 3M's certified distributors, because agents from other countries showed up first with cash in hand. When he asked 3M's people if they instructed their distributors to prioritize American purchasers first, they said no, and didn't seem to find that a problem. That's beyond disgusting.

Betting against our president hasn't panned out well for.... anyone so far. The PR value alone of his bully pulpit may not daunt some with no skin in the game but I bet 3M is not quite so flippant. And hopefully the globalism 3M's callous move represents will be biggest casualty of the Chinese Virus.

See you in court #2? By all means GO for it 3M!! Take POTUS to Court for standing up for nurses and providers who are working with masks that nurses and providers are having to buy off Amazon because 3M and their distributors will not provide in bulk to the state of Florida so they can distribute. My daughter in ORLANDO has 3 COVID patients in ICU and she is using a mask that is way passed safety standards without constantly disinfecting. So yes 3M go for it, 3M may win the case but in the meantime the company will burn..They stink!

Not so sure #6. Bending bad laws due to extreme circumstances won't help us get rid of bad laws. I'd like to see 3M blasted down to 2M but not by joining the left in lawlessness.
#1 is on the right track. Our government has all but mandated that industry move the hell out. By imposing costly regulations not imposed or offset for imports, the highest corporate tax rates, by tolerating value added tax sleight of hand serving a s 40% tariff, what did anyone think would happen? One of my personal business goals was to minimize profit in the US. When Obama's nut cuttin for America time came in 2008 guess who closed down?

Paying “cash” for these masks? What are they doing? Rolling up with suitcases full of $100 bills? I don’t think so. They either cut a check or electronically write the money to pay. I’m not buying that they have an edge on purchasing because they pay cash. More fake news?

Yes, #5...that's right. See PDT in court. Let's just use hysteria as an excuse to put aside the U.S. Constitution and start grabbing property and services for the good of society. To use the Defense Production Act as a basis for this is plainly out of bounds. Read the law. This is what dictators do...abuse and misuse emergency laws and legislation.

As I said in a reply to the 3M article above this one, L-Dotters of good faith don't always agree, and these are disagreeable times. I've read #2/#10's thoughtful replies with interest for more years than most. I see no trolling in pointing that a good president using a bad interpretation of a dubious law to exceed his authority isn't exactly conservative. And it may not be legal. We have a Constitution to protect us, and we need to protect it in return -- perhaps even more so now, when there are so many reasons we might not want to.
More broadly, one of the astonishing things about all of this to me is the absence of court actions. One year ago, President Trump couldn't issue fully-constitutional orders to Federal agencies to enforce the law without some District Court judge jumping into his injunction jammies and filing a writs to stop him. Now the courts are standing by while state Governors issue orders to citizens regarding when and where they're permitted to peaceably assemble.
The ACLU is only one of many dogs that aren't barking right now. When this is over, there will be a parade of litigants over the rights and laws that are being trampled now. And there will be an unholy reckoning against the so-called experts who have advised the public so poorly throughout this "crisis."
