A federal judge on Monday rejected Michael Flynn's comprehensive requests for exculpatory information that may have been withheld by the FBI, saying that the former national security adviser had waived his fundamental constitutional rights by pleading guilty to making false statements.
The order from U.S. District Judge Emmet Sullivan in Washington also set a Jan. 28 sentencing date in the case, and essentially crushed any remaining hopes that Flynn might see his guilty plea tossed. The ruling came just days after Justice Department Inspector General Michael E. Horowitz identified a slew of misconduct by FBI agents investigating former Trump aide Carter Page -- including by a little-known agent

This decision is truly disappointing. Clearly, the FBI at the time of interviewing Gen. Flynn was on a mission to get him. Whether he pled guilty should be a moot issue if there was exculpatory evidence out there exonerating him. How can anyone sworn to uphold the law rule that because Flynn was coerced to plead guilty in order to save his son from FBI harassment that that would forever remove his Fourth Amendment rights? This decision further uses the power of the federal government as a cudgel against the General. He is damned if he does or damned if he doesn’t. Even worse, this whole fiasco was predicated on a corrupt FBI interview. They set a trap to destroy him simply because they could. In what world is this considered justice? Flynn’s crime in the minds of these Deep State enforcers was defying Obama and they were determined to make him pay. The Obama administration has to be the most corrupt and vindictive cabal in the history of the country. No surprise there. It’s standard operating procedure for fascists.

Sad day for America. Flynn had his son's future threatened by the FBI. His confession was extorted. I pray that every single one involved gets what they deserve. Mr. Durham is my hope for our country's future.

Hey, Judgie-Poo, what if he only pleaded guilty because of the false evidence arrayed against him and his family? Congress needs to restrict the federal courts' jurisdiction to domestic relations matters.

This is the same judge that let the Dept of Just-Us railroad Senator Stevens. Once Stevens lost his reeelection bid, Sullivan acted as if he was really really upset the Dept of Just-Us withheld evidence. Sullivan is a go to guy for the Democrats. This decision was a forgone conclusion.

The judge, Comey’s FBI goons and Mueller’s SC fanatics all did what what we knew they would do. What’s shocking is that Trump’s DoJ allowed this show trial to continue. President is now faced with having to pardon Flynn rather than having AG Barr’s DoJ drop charges due to Comey’s entrapment of Flynn. If Barr’s lack of action on Flynn and Roger Stone, convicted just weeks ago by Trump’s DoJ, not Obama’s, are any indication, the Durham investigation will be an enormous disappointment.
After 3 years that produced a mountain of damning evidence against Obama, Hillary, Brennan. Comey and their ilk, the only officials prosecuted were those assisting candidate and then President Trump,

Another Swamp judge, aiding and abetting FBI corruption. When does it stop? This judge ignored a lot in order to come to this decision. He didn't give up his rights, he had them stolen from him by Mueller threatening his son. Why does this idiot on the bench not get that?

This one is a challenge. Flynn knew he was not guilty and in knowing that he plead guilty. The judge is in a no win place. He must think in the terms of what it would do to all such guilty pleas and not just this one. Part of a guilty plea is often includes the dropping of other charges in exchange for the agreed upon one. Would thus then open the door for the prosecutor to bring up the other charges? Would it then allow the prosecutor to go after Flynn's son? I don't know. Flynn is a tough situation. It is clearly an injustice but Flynn is an adult and he knew he was innocent when he made the bargain with the devil. Glad I'm not the judge.

Logic suggest that unless a person deliberately renounces his US citizenship he cannot waive his constitutional rights just as he cannot waive his constitutional responsibilities. But then benighted legal profession is well known for its "legal fictions" which deny not only logic but even the reality of "things as they are".
