Former Democrat presidential candidate Hillary Clinton tweeted on Friday that there is no question that President Trump “committed impeachable crimes” and suggested that the only thing standing between the president and the wrath of the law is his Republican allies. Clinton has not hidden her opinion throughout the seven public impeachment hearings that the House Intelligence Committee has held over the course of the last two weeks. The articles of impeachment against Nixon were for obstruction of justice, abuse of power, and contempt of Congress. I suspect the House Judiciary Committee will try to reuse these gems in the absence of treason, bribery, or high crimes and misdemeanors since there is no evidence to support these real crimes.
In Nixon's case he did refuse to turn over the White House Tapes until the courts forced him to but this could have been defended as simply defending the separation of powers. What did him in was the "Smoking Gun Tape" where he discussed payments to the Watergate burglars to get them to perjure themselves which was obstruction of justice. None of the charges were ever tested in a Senate trial so we don't know if they would have worked since Nixon resigned after his approval ratings fell through the floor.
Given the fact that he has already released the innocuous Ukrainian phone call transcript there's not anything left to "surprise" the public. I don't believe abuse of power or contempt of Congress is a crime under any statute. Abuse of office is a crime if a prosecutor or government official uses coercive methods to obtain convictions or intimidate persons charged with crimes but that clearly isn't what we're dealing with here. After watching the inquiry circus last week I consider contempt of Congress a virtue, not a crime.
The Constitution does not prevent the House from making up whatever they want but ultimately the Senate will need to determine if these events rise to the level of impeachable acts as intended by Article 2 Section 4. In the process we'll get to drag Hunter and Joe, Adam and Eric, and maybe even Viktor Shokin before the Senate. This will allow us to explore why it is a really good idea to have a foreign government assist our DOJ in investigating a political opponent if they are part of a criminal violation of the Foreign Corrupt Practices Act.
