Many violent crimes are bargained down to lesser, non-violent crimes in order to reach a plea agreement. Hence many of the "non-violent" criminals actually are.

Not a gaffe. This was Obama's position when he loosed thousands of inmates (mostly black of course) on the streets only to have most of them commit further crimes. This is like turning an alcoholic loose in a bar and asking him to behave himself. No amount of wishful thinking makes it better.
