The engineer who was operating an NJ Transit train that crashed in Hoboken Terminal in September 2016, killing a woman walking through the station and injuring 108, will return to work after winning an appeal. Thomas Gallagher, who blacked out at the controls on Sept. 29, 2016, due to undiagnosed sleep apnea, won his arbitration case on Aug. 28 and will be reinstated as an engineer, as long as he meets medical conditions and continues sleep apnea treatment.(Snip) The train sped up to 21 mph, twice the posted speed limit, crashed through a concrete bumper at the end of track five

Comments:

The NTSB says NJ Transit didn't do enough to screen employees for sleep apnea. Presumably employers must also screen workers for a nearly infinite number of conditions that might contribute to injury and death on the job, thus ensuring job security for those working at the NTSB. Ain't it grand?

I know I sound flippant, but how long will it be until someone gets in trouble and then says he "identifies" as someone with sleep apnea? I sure don't think I would like to ride on that guy's train. I am guessing he will be paid engineer's wages for having a desk job in the transit department. Kind of like teachers who goof off and abuse children in New York.

Well that is comforting, if this character gets a lousy nights sleep some other poor schmuck is toast. One of the biggest problems with sleep apnea is patients failure to comply.

Let me comment as a retired arbitrator. In 31 years as an arbitrator, I can only recall two instances where I reinstated an employee without any back pay. And each case had unique circumstances. I would have to see the labor agreement in this case, as well as the NJ Transit rules on medical screening, as well as the testimony of the physician who examined the grievant. I would also expect the parties to offer expert witness testimony. This case is not as simple as it appears to be.

This is the stuff that can make a sensible person want to run screaming into the street. I wouldn’t want this guy driving a car, let alone a train. So he’s not to carry passengers? He also killed a woman who was walking through the station. Be serious. Some employees cannot and should not be “salvaged”. Desk job? Maybe. Running a train? Never, ever...

Sorry #4 but your labor agreement does not have priority over people’s lives. That’s why unions are dying. If this guy has sleep apnia he should have never qualified for this job to begin with. Thank the union.

City contractors would have to reveal past ties to slavery under a Council bill that will be introduced on Thursday. The legislation would require companies to search their history and records to determine if they or any affiliated entities engaged in or profited from the slave trade when they enter in or renew city contracts of $100,000 or more. “New York City is the financial capital of the world, and the ugly truth is that its stature as such has roots in the slave trade,” Councilman I. Daneek Miller, a co-sponsor of the legislation with Councilwoman Inez Barron (D-Brooklyn).

Morristown—New Jersey officials says they’re done doing business with any gun manufacturers that don’t play by their rules. Governor Phil Murphy signed an executive order Tuesday demanding gun makers turn over their practices to the state, and this applies to banks that do business with New Jersey, too.(Snip) New Jersey is a $70 million buyer in the gun business as the state supplies police with weapons and ammo annually. And that number does not include local towns and counties. Murphy wants to use his buying power to force manufactures to publicly say they support universal background checks and responsible gun sales.

A former top official in the Federal Emergency Management Agency was arrested on Tuesday for allegedly taking bribes from the head of a company who received $1.8 billion in federal contracts to repair Puerto Rico’s power grid after Hurricane Maria devastated the island in 2017. Ahsha Tribble, a deputy regional administrator, another former FEMA official, Jovanda Patterson, and Donald Keith Ellison, the former president of COBRA Acquisitions, were charged in a 15-count indictment. Patterson, Tribble’s deputy chief of staff, steered contracts to COBRA and left FEMA in July 2018 for a job at the energy company, the court documents say.

AUSTIN— Twenty-two Greenpeace USA activists created a blockade on the Fred Hartman Bridge in Baytown, Texas early Thursday ahead of the third Democratic primary debate in Houston. Eleven of those climbers are dangling over the side of the bridge, an activist said in a Facebook Live video. The climbers held colorful ribbons and streamers to block traffic under the bridge.
