Congress recently passed, and President Trump signed, the "Right to Try" bill that gives dying patients limited access to drugs that have not yet been approved by the Food and Drug Administration. Our Founders would be astonished that we need such a bill. Nowhere does the U.S. Constitution give the federal government the authority to regulate the practice of medicine. And it is a very good thing that federal intervention and standards didn´t begin in 1789. Standards are always based on what the authorities think are "best practices." Until rather recently, most medical treatment was ineffective and often quite harmful:

If anyone doubts that quacks will be offering worthless cures under such a program one need only look at what´s already available offshore. Not untried treatments, treatments in some cases that have already been tried and don´t work. Stem cell treatment in many of its forms is a case in point. Want to try this? Fine. But don´t demand that the government or your insurance company pay for it because that hurts everyone by draining financial resources for no good reason.

The Federal Goobernment passed a law mandating that insurance pay for bone marrow transpalnt (basically stem cell) in women with breast cancer. Its still the law. But nobody gets this treatment. Why? Eventually research showed that it killed women, not save them. The study was so profound that it was cut short to save lives and the New England Journal of Medicine rushed publication so the medical world would know that this treatment was inefective and dangerous. People have a right to their bodies and are incredibly susceptible to fraudulent claims when they are desperate. Yes, they should have a right to decide what they want to do with their bodies. THe same rights any wonman has when she wants to kill her unborn child. But there has to be appropriate ethics and a solid scientific bases for a study so that others can learn what the treatment actually does and protect those that doen´t have enough knowledge about medicine and the experiement to make an informed consumer decision..

What we should have is a VERY clear law that says these unverified treatments are tried AT THE PATIENT´S OWN RISK. No one should be able to be sued for side effects, including death.

As to paying, if these are drugs in clinical study, the company should pay as a form of extended testing.

Treatments that have no formal evaluations in process? That leaves things open to fraud.

Caveat emptor. And a full release from insurance payments. The "right to try" does not obligate anyone else to pick up the bills. Death is inevitable...no one gets out alive.

This article is Superb. I picked out five excellent zingers but all of it needs to be studied carefully. This good doctor should be appointed to study all laws regulating medical practice and come up with a "Real Right to Try Law" . The FDA like most Goobermint agencies is protecting itself and its paymaster Big Pharma. There is a revolving door for personnel between Big Pharma and the FDA regulator which should be shut down. There could be a two stage approval where treatments that are non toxic and safe are available to all. As for paying how about an alternative to Obamacare that allows patients to save money tax free and spend it on their own care if needed. As Goldman Sachs pointed out, curing disease is bad for business.

It´s also bad for bureaucrats. Gilead recently brought out the only drug that cured a chronic malady. The FDA delayed approval because it cost too much.

Shouldn´t medical care be decided by a physician and patient? Apparently not.
Most policies have hidden in the language that if you do a clinical research trial and something goes wrong, the insurer will not pay for your care.

When I saw my doctor for a refill, not only does the Beer´s List say I can´t it because of my age, but someone at the insurer without a medical degree, who has never seen me, says if my doctor writes the script again, he could lose his contract. It is okay if they give me something to scramble my brains that will make me commit suicide or shoot strangers.

It does not matter what condition a person is in for the little blue pill to be prescribed.
