A coalition that includes a Latino membership organization and a former Massachusetts governor filed lawsuits on Wednesday challenging how four U.S. states allocate their Electoral College votes in presidential elections. The lawsuits were filed in federal courts in Massachusetts and California, states that went for Democratic nominee Hillary Clinton in 2016, and South Carolina and Texas, where a majority of votes went to Republican U.S. President Donald Trump. The electors for the person who gets the most votes go to the winner.

The winner is the winner regardless of party.


In primaries, states can decide to give proportional counts to determine run-off, with the eventual top vote getter being elected.

This is stuff and nonsense to do that in a national presidential election.

The rules were followed. Even the hanging chads and dimpled chads could not stop George W. Bush from winning Florida, and they are still belly aching about that one.

The election laws that were on the books were FOLLOWED, and the results canvassed. End of the story.

Live with it. Majority wins on this one.

Not one of these idiots filing the lawsuit read the Founders reasoning behind the electoral college. It makes total sense.

In addition, reports make it clear that Clinton received more than 3 million votes of illegal immigrants and fraudulent voters.

How abut requiring Voter ID? I cannot do anything without an ID. I will even favor free ID´s for anyone not having a driver´s license. Democrats act like Communists and Communists have no role in America.

Liberal Dems will do anything to win. This is nothing more than a veiled attempt to increase their chances. They cannot get the electoral college overturned because that would take a constitutional amendment, so they are trying instead to orchestrate the outcome to favor their candidates.

Don´t laugh too hard. With the plague of activist federal judges at all levels, certain that they are the true rulers of the nation (and have been getting away with it for more than 200 years), anything is possible. Anything.
Yes, it should be laughed out of court. Certainly. But EVERY.Single.Shyster.Lawyer who filed this ridiculously frivolous action should not only be summarily disbarred, they should all be recipients of public floggings. Along with the plaintiffs of record.

Interesting argument. Plaintiffs have two problems. The first is standing. The second is even more obvious...the EC by design does not appotion equally, any more than the senate doe. If the senate is constitutional, then perforce the EC design is constitutional, and the constitutional plan of allowing states to decide electos myst be. I only hope tgat when the plaintiffs lose bigly, they have to pay defense costs

Article 2, Section 1 does not even require an election to determine electors. There is no requirement that all electoral votes go to the popular winner in the state.

"Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress..."

What the popular vote advocates don´t want people to know is that without the electoral college, 7-9 metropolitan areas could elect every president forevermore. No presidential candiate would have reason to leave the largest states. No presidential candidate would care what nearly 50 states said, did or wanted. They wouldn´t matter for getting elected or re-elected. The smaller states of the original 13 understood this. Communists don´t like it because it spreads the wealth where it really matters.

The Constitution clearly states that the legislature of each state has the authority and responsibility to apportion the electoral votes to which that state is entitled.

Why were the suits filed in federal court rather than in each states´ court?

The article briefly mentions that two states (Maine and Nebraska) allocate their electoral votes in a proportional manner, which is the prerogative of the legislatures in those states.

A fair way to allocate electoral votes is by Congressional District, with the candidate who receives a majority of votes in a Congressional District receiving one electoral vote. Two additional electoral votes (those associated with the number of Senators from that state) would go the the overall winner of the popular vote in that state.

Again, this decision should be made in the state legislature. There is no need for a Constitutional Amendment for it to be implemented.

Most States quit counting votes after the reach the threshold for determining the winner beyond the shadow of a doubt. Therefore the polls would stay open until the Democrats could back all the old station-wagons filled with fake ballots up to the polling stations until they decide in favor of the Dem puke.

The Founding Fathers knew more about human nature and wrote the Constitution they way it is for a reason. Show me one Latin American country that has been stable as long as we have. If the Latinos don´t like it maybe they would be happier in Venezuela where the dictator was selected by the majority.

The Bush family has a famously adversarial relationship with English. It became clear this week that at least one of them is also illiterate where U.S. history and immigration policy are concerned. This was demonstrated when former First Lady Laura Bush took to the pages of the Washington Post to denounce President Trump for enforcing a statute signed into law by her own husband, George W. Bush. Even worse, she compared the HHS facilities where the children of illegal immigrants are briefly housed to the infamous internment camps where Democrat icon FDR imprisoned 110,000 American citizens of Japanese descent.
