San Francisco District Attorney George Gascón announced today that his office will proactively expunge and seal the records of misdemeanor marijuana offenders, the San Francisco Chroniclereports. The office will also resentence offenders who received a felony pot conviction. Proposition 64, the 2016 referendum item that legalized recreational marijuana in California, allows pot offenders to petition for resentencing if their crime would have received a different penalty, or no penalty at all, under the new law. I don´t see anything wrong with this at all. Misdemeanors should be expunged and not count against anyone´s record except assaults and theft.

All above are correct. Marijuana, even in its more potent modern forms, is a baby drug compared with alcohol and all the hard drugs (heroin, cocaine, meth, etc.) It´s impossible to OD on it because it isn´t potent enough. (Ask MoDo, who had to go to bed after eating too many marijuana edibles. As she said, she couldn´t "handle her candy.") The only reason why it is a "gateway" drug is that its black market sellers also sell the hard stuff.

Not a big deal. Under Calif.´Penal Code Sec. 1203.5, most misdemeanors can be dismissed after ar least one year and end of probation and no violations. Minor marijuana offenses for personal use are usually suspended during a prescribed period of rehabillitative diversion, after which the case is dismissed.
