A Ludicrous Ruling That Trump Can’t End DACA
National Review Online, by Josh Blackman

Original Article

Posted By:MissMolly, 1/11/2018 4:52:41 AM

On January 20, 2017, the executive power peacefully transitioned from President Obama to President Trump. At least one judge in San Francisco didn’t get the memo. Yesterday, Judge William Alsup ordered the Trump administration to keep its predecessor’s Deferred Action for Childhood Arrivals (DACA) program in place. This remarkable 49-page order has all the aesthetics of a judicial decision but is, at heart, an amateur act of punditry. Judge Alsup paints the picture of a divided White House, wherein “the Chief Executive publicly favors the very program [his Administration] has ended.” Citing a “presidential tweet,” the court suggests that DACA’s

Look on the bright side. When CA finally slides off into the Pacific, the 9th circuit will go with it.

Jeff Sessions is not responsible for the impeachment of the judge. The House of Representatives is, and with a positive vote to impeach, the matter is sent to the Senate, where a 2/3 majority is needed to remove the judge.
What Jeff Sessions can do is to have the Solicitor General file an expedited request to the U.S. Supreme Court to handle the immigration issue. The Court, in turn, can do what it did to the 9th circuit back in the 1990s on a death penalty case.A. It can instruct the circuit to stop ruling on pending immigration issues. And the order can apply to all circuits.

A democrat socialist POTUS can enact DACA but a Republican POTUS cannot reverse that decision. Gee wiz perhaps that´s why we have a congress and a constitution so we have a consistent form of government and don´t become a completely different nation with every change at the top.

And it´s important top note that Trump, rather than doing as Obama did and abuse his power, correctly handed the issue to congress where it belongs.

Trump should just say, "This is the reversal of an illegal executive order, and is beyond the perview of the judiciary, entirely an Executive Branch issue."

Then ignore their tantrums.

No, don´t appeal it to higher judicial bullies : just defy it. No one in black robes - including SCOTUS - has authority in this matter.

POTUS: just rescind DACA now. No deals, no waiting, no March deadline. Just rescind it.

THen it´s time for repatriation of the "kids", with their parents/family/faux families. When their Congressional advocates (advocates for ILLEGAL aliens) whine about these "kids" only knowing English, well, their parents still speak their native languages. They´ll do fine!

Send them home in an orderly fashion, but speedily, starting with the most recent arrivals. Then they can begin the process of applying for temporary alien status or green card or something.

Hafner, a Democrat running for Congress in Alaska’s primary, listed two addresses on her candidate filing form: one in New Jersey and one in South Dakota. While she considers South Dakota her home base, Hafner told The Associated Press that she travels a lot and has been in New Jersey to deal with an illness in the family. 77 Times Barack Obama Was Totally Wrong

"What if we were wrong?" That is the question then-President Barack Obama asked as he rode along in his presidential limousine with his foreign policy guru Ben Rhodes. The question came in the aftermath of the surprise presidential election victory by political newcomer and television reality star Donald Trump. Obama questioned whether he and liberals had forgotten how important identity was to people and had pushed a progressive agenda too far, too quickly. Obama wasn´t only wrong in understanding where the electorate was in 2016 but was frequently wrong throughout his presidency. The following Washington Free Beacon supercut displays 77 instances when Obama

A sunken Russian warship believed to contain $130 billion in gold bullion and coins has been found off the coast of a South Korean island — 113 years after it was scuttled during the Russo-Japanese War, reports said. A joint team including South Korean, British and Canadian explorers on Sunday found the wreck of the Dmitrii Donskoi more than 1,400 feet below sea level and a mile off the coast of the South Korean island of Ulleungdo, according to CNBC. The Russian Imperial Navy cruiser was carrying about 5,500 boxes of gold bars and coins — weighing some 200 tons — when

Brockton, Mass., is known as the birthplace of boxing legend Rocky Marciano. But with U.S. Sen. Elizabeth Warren pushing for a $1 billion Native American casino less than 20 miles away, struggling blue-collar Brockton´s competing casino bid might not stand a fighting chance. Brockton Mayor William Carpenter slammed Warren’s bill on behalf of the Masphee Wampanoag tribe, which would override a federal judge´s decision last year to block the tribe’s plan for a luxury gaming resort in East Taunton. He says Warren seems to be acting on behalf of special interests instead of people like Brockton´s struggling residents.

If history tells us anything, it’s that they may not get another chance, even if Trump is re-elected in 2020. The rest were appointed and confirmed in the brief periods when one party controlled both the White House and the Senate. When did OJ become POTUS? President Trump told a Helsinki press conference Monday that Russian strongman Vladimir Putin has an “interesting idea” about resolving questions on election meddling in the 2016 election: create a joint American-Russian committee on inquiry. That is, Moscow and Washington will together investigate whether Russian agents were responsible for hacking the DNC computers, as a US prosecutor answerable to Trump alleged late last week. They’ll find who’s responsible for other election shenanigans, which Trump’s top intel officials believe to be Russia’s handiwork.
