The government cannot censor trademarks on the grounds they may be offensive to some, the Supreme Court ruled Monday in a major decision that could also clear the way for the Washington Redskins football team to maintain its trademarks. The case before the high court involved an Asian rock band named “The Slants.” The U.S. Patent and Trademark Office originally denying the band’s name, saying it was a racial slur that violated the agency’s policy, based on federal law, that prohibits granting disparaging trademarks. I heard a quote about this ruling that wasn´t in the article, and of course, I can´t recall it, exactly.

Effectively, it said the words might be offensive to some, but that they were not being used to disparage an individual or group.

The Slants are calling themselves that, and the Redskins are doing exactly the opposite of disparaging.

And I´m still a cracker.

I have hypothesized that were there no Indians, Braves, Redskins or Warriors as team names, that would be evidence of racism in the eyes of the easily offended.

Could the NCAA run into trouble for this? If the college team has trademarked its logo and mascot, is the NCAA violating freedom of speech. Yes its a private organization but the public schools that are part of the NCAA can´t, by law prohibit free speech. One wonders.

Who in their right mind would choose a disparaging word as a trademark? If a word is chosen, it´s typically because it honors rather than disparages, as is the case with the Redskins.
