WASHINGTON — The Supreme Court struck down a North Carolina law Monday that bars convicted sex offenders from Facebook, Twitter and other popular sites. The justices ruled unanimously in favor of North Carolina resident Lester Packingham Jr. His Facebook boast about beating a traffic ticket led to his conviction for violating a 2008 law aimed at keeping sex offenders off internet sites children might use. The court rejected the state’s argument that the law deals with the virtual world in the same way that states keep sex offenders out of playgrounds and other places children visit.
I actually agree with this. The Constitution doesn´t say we forfeit our right to political speech just because we have been convicted of a crime. If the goobernment can limit political speech due to a particular crime, then it can limited political speech with any crime. Sexual predators are despicable to be sure. And we as a society must do all that is possible to protect children. But eliminating rights isn´t the way to do that cause it opens the door to limit all our rights. One can imagine Chicago making it a crime to be on Facebook after being convicted of having obtained an unregistered illegal firearm. Or making it illegal to be on twitter after being arrested at an anti-abortion protest. Limiting free speech is an attack on all our rights to free political speech.
The Supremes are the only group of Judges in America that I know of who don´t always have a clue when it comes to the virtual world of the internet, or to how to protect kids from the deviants of the world.
They really need to get a clue and get up to speed. Free speech is something to protect certainly. But that should not give predators the right to prowl where the young hang out.
Unilateral SCOTUS judicial review of state law is unConstitutional, period. Marbury v Madison is what must be "nullified". SCOTUS can (and should) render its opinion on the matter, but should then remand it back to the state or federal legislature responsible for it.
