Following the massacre of grammar-school children in Newtown, Conn., in December 2012, high-powered weapons have been used to kill innocent victims in more senseless public incidents. Those killings, however, are only a fragment of the total harm caused by the misuse of firearms. Each year, more than 30,000 people die in the United States in firearm-related incidents. Many of those deaths involve handguns. The adoption of rules that will lessen the number of those incidents should be a matter of primary concern to both federal and state legislators. Legislatures are in a far better position than judges to assess the

Here is Stevens´ pathetic attempt at convoluting the language of the second amendment:

“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms when serving in the Militia shall not be infringed.”

In other words, you have no individual right to own a gun. This guy did enough damage while he was on the court. There is no further reason to take him seriously.

Justice Stevens is dead wrong.
The intent was to PROTECT citizens from the government (in the original case the British).
He is just an old hag liberal trying to take away our guns.
He needs to read many of the British opposition writers, Cato´s Letters, to get the true flavor of what our founders had in mind and why it was absolutely to protect the rights of citizens to their guns that was behind the 2nd amendment.

He talks about the "emotional" arguments favoring gun rights -- and then harps on the very emotional massacre of kids in Newtown to argue against gun rights.

When our founding documents were written, it was normal to have a weapon -- for self-defense and hunting -- even if you were not in a militia. The Second Amendment was to prevent the British from confiscating guns of all kinds under the pretext of stamping out "militias".

What a smart idiot. How about enforce gun laws and report mental cases to the FBI NICS database - Visit fixnics.org - MA still has only reported 1 case and Rhode Island -0. These are MENTAL patients that are not on a Don´t-sell-them-a-gun database that are doing this. Stevens either a fool or is absolutely dishonest. I don´t think he is a fool.

The Federalist Papers were written by the framers of the Constitution to explain EXACTLY what it meant. Stevens either has never bothered to read this "Cliff Notes for the Consitution" or willfully means to distort it to support his antigun lie. They meant for us to have ALL ARMS, including cannon - as were commonly used by local militias - owned by the individuals or groups of individuals, NOT the state.

Either way - forget this nonfactual claptrap. This bull was used for decades to defang the 2nd Amendment, which was INTENDED to give us all serious arms, specifically to defeat an overreaching military, and to defend ourselves from more ordinary threats.

Question: If the second amendment as written permits arms only for Stevens´ definition of militias; why didn´t the Government confiscate all private arms immediately after the Constitution was ratified? You know, 200+ years ago?

It takes longer to die and is more painful to die from a knife wound, or several, than from a gunshot.

Also, of the 30,000 killed by firearms, how many were accidents, how many were justified, how many of those people are we just better off without, anyway? Two gang members have a shoot out and one dies. Who cares?

I sure don´t. And if it weren´t for liberal (stupid) policies, most senseless firearm related deaths would not occur. It´s because we let the loonies run around loose that half the senseless murders occur.

One of the first acts of Congress was to define the militia as all able bodied men 18-65. They were to provide THEIR OWN WEAPONS.

That would be hard to do, if they did not OWN weapons and the ability to buy and sell them as needed.

Wouldn´t a more honorable man be a little more honest with the statistics he uses? The CDC reports some 11,000 firearm related homicides and some 19,000 firearm related suicides. I´d imagine that, unfortunately, a fair number of the 19,000 would find another way to kill themselves if they had no gun.

Contrary to his transparent attempt to disarm American Citizens, we should add a new amendment to the constitution along the lines of:

´All legal residence of good standing and sound mind of the United States who are Citizens or have officially expressed the desire to become Citizens are members of the Free and Independent Militia of America and its possessions and protectorates and may arm themselves at all times for their own protection, the protection of others and the protection of America.´
