House Oversight and Government Reform Committee Chairman Darrell Issa said embattled IRS official Lois Lerner waived her Fifth Amendment rights and will be hauled back to appear before his panel again. The California Republican said Lerner’s Fifth Amendment right to avoid self-incrimination was voided when she gave an opening statement this morning denying any wrongdoing and professing pride in her government service. “When I asked her her questions from the very beginning, I did so so she could assert her rights prior to any statement,” Issa told POLITICO. “She chose not to do so — so she waived.”

It was Trey Gowdy who so forcefully made this point immediately after LL pled the 5th. Issa took a momentary break and then resumed, allowing her to leave. I´m glad they revisted the issue and that she will have to come back. Let´s see how many variations on "I don´t recall" or "It wasn´t my fault" she can muster.
And - there was loud and sustained applause for Gowdy!

I hope that congress can provide an effective consequence for Ms. Lerner, should she continue to refuse to testify.

Issa and Gowdy can be right as rain but it won´t matter unless they can punish the woman if need be.

The problem is, there´s so many people involved in this that they can´t get their lies coordinated.

It´s not one of those deals where one person tells a lie and only two other people have to swear to it.

And if you think Lerner is under the bus now, wait until those "low level" employees get the squeeze put on them and they begin to talk.

I don´t know where the Low Level´s marching orders came from but they do, and before it´s over, they´ll give up a name [or two].

Trey Gowdy is the one who stood up to her nonsense. He is apparently a former Federal prosecutor in the United States Attorney´s office in South Carolina.

This is great.

Here´s how it might play out.

She is called back and told she has waived her rights and must testify. She does and heads start to role. OR she refuses and they cite her for contempt. Then that will go before a judge to determine if she did or did not waive her rights. If the judge decides not, she is off the hook. If the judge says she did waive her rights she is back before the committee and either testifies or goes to jail for contempt.

It will be interesting to see how this plays out. It will also be interesting to see if BO defends her. With so many people angry with her refusal to talk, there is going to be mounting pressure to fire her.

I see problems with such a "waiver." What if you are called to the stand and asked your name, some background info, but at some point later the questions asks some questions that might tend to incriminate you. Surely you can raise your rights at that point.

A chairman doesn´t have the individual right to give immunization to a witness. The committee has to vote on it. The Administration now has a problem. Only solution they coud have is to invite Ms. Lerner to a picnic at Ft. Marcy Park. They can´t fire her, she will start singing. Keeping her on just invites more inspection on what the president knew.

Gowdy spoke but he said Cummings had brought this to his attention saying she had waived her rights when she spoke, then Cummings said he meant in a federal court this would cause a waiver. So Issa dismissed her.

I´ll believe it when I see it! Issa had every opportunity this AM when Trey Gowdy challenged that Ms. Lerner waived her rights with opening statement (which I thought was odd from get go -- who makes a statement and then evokes 5th amendment). But Issa let her go...she´ll never see that committee again I´m betting. Rep´s are so weak when it comes to actually holding anyone accountable for anything -- unless your last name is either Nixon or Bush.
