Defense lawyer Jack McMahon delivered his closing argument on behalf of abortionist Kermit Gosnell on Monday, accusing prosecutors of “manipulating” the case to engage in an essentially “racist” prosecution of the man charged with four counts of first-degree murder, killing babies born alive during abortions by snipping their spinal cords with surgical scissors. “Never have I seen the presumption of innocence so trampled on, stomped on,” said McMahon in court today, adding that the Philadelphia district attorney’s office “tried to manipulate everybody” and was pursuing an “elitist, racist prosecution.” “Dr. Gosnell is not the only one doing

Sickening and shameful to hear that word, innocence, used in defense of such evil even in the context of presumption.
The word itself is soiled and abused just by being spoken in connection with Gosnell, after the pure evil true innocence has suffered at his hands for so many years.

That Gosnell is black and that most of his ´patients´ were black is one big reason the MSM has failed to highlight this trial. That is the real racism. Their elitism show when they refuse to look at the real ugliness of abortion.

When a prosecutor moves a case to trial, he does not have a presumption of innocence. He has to believe that the defendant is guilty beyond a reasonable doubt to move forward to trial.
The defense attorney seems not to understand the process.

I am curious how many of these were paid for by the taxpayer. I do not agree with abortion but think it is ultimatly the mothers decision to raise the child. However that being said I do not think it should be used as a form of contraception.

If Gosnell were white, and had murdered all those black babies, there would be an uproar.

A majority of the jury must be black or there would be no need for McMahon to throw the race card into the trial. Now the question is - do the jury members care more about the skin color of the abortionist or the hundreds of murdered babies? And it was hundreds. He is on trial for murdering four, but testimony has shown that he "snipped" hundreds.

The reason this defense is used is because it works.

That´s exactly the same defense the Obama Administration used to get reelected: "If you vote for Romney, you´re an elitist and a racist". It works particularly well on low-information voters, i.e., the same type of people who get past the screeners to be on juries.

Mr. McMahon,

The presumption of innocence in Judicial process is applicable only to the Judgen presiding over the trial and the Jury adjudicating the trial. Beyond those thirteen individuals all others in the courtroom are entitled by their humanity to form their own opinion regarding the defendant. Granted, we prefer that our court reporters maintain a veneer of dis-interest. It would look reporter to burst out in a fit of laughter at some of the preposterous theories that have been offered by defense counsel. O.J.´s bag consolidation at the airport was one of my favorites. But beyond that professional requirement all other parties to the trial, particularly the prosecution, have made a determination of probable guilt. As a matter of practice, if a prosecutor were to bring charges against a person that they considered innocent, such an action would reak of prosecutorial misconduct (Duke Lacross team).

As damning as the facts against him, I fear that there just might be a hung jury on this case. Reason? This case is being tried in Philadelphia, a city that has a very large black population. And all it takes in ONE juror to hang a jury. If that happens, then the prosecutor is faced with the decision to re-try the defendant or let him go. I´d keep re-trying him until justice is served.

The tip of the iceberg. There is so much guilt by these killings, it will take God to serve justice. Consider how we are told that something dysfunctional happened in this clinic, that it was the exception. He was a bad murderer, he should have only killed when the baby was inside the womb. And the dead baby pickup? Well they are collected for experiments, and "harvesting" and other useful things.

Planned Parenthood? They serve woman´s needs, they need a fund raiser, and a knight in shining armor to sing their praises. Obama, if he had a Dad, would look like Gosnell.

The defense is the elitist, and the racist. This kind of approved murder is not to be stopped, or even besmirched.
