Perform Criminal Background
Checks at Your Peril

The Wall Street Journal, by JAMES BOVARD

Should it be a federal crime for businesses to refuse to hire ex-convicts? Yes, according to the Equal Employment Opportunity Commission, which recently released 20,000 convoluted words of regulatory "guidance" to direct businesses to hire more felons and other ex-offenders. ... It is difficult to overstate the EEOC´s zealotry on this issue. The agency is demanding that one of Mr. Livingston´s clients—the Freeman Companies, a convention and corporate events planner—pay compensation to rejected job applicants who lied about their criminal records.

As I understand it, prisoners have worked for years on phone lines, for all sorts of companies you might call. What happened to making license plates, & doing laundry?

Back in the 1980s, the EEOC sued the city of San Antonio, Texas, for using criminal records to disqualify police applicants. EEOC said that had the unfortunate impact on hispanics and blacks, who were more likely to have criminal records.
The EEOC lost.

It is only fair that the private sector should follow the path blazed by Obama in his public sector (including Czar positions) hiring.
Obama has hired or surrounded himself with more convicted and unindicted felons than any Administration in history--Tim Geithner, Eric "The Red" Holder, Bill Ayers, Kas Sunstein, Bernadatte Dohrn, Nancy Pelosi, George Soros, etc.

As the article points out the regulation will hurt rather than help blacks because employers will simply not consider them in the first place. Of course a way around the reg is to get a detailed and verifiable employment history from a job applicant.

The simplest method for avoiding this Obama maddness is to not hire at all. This EEOC obstacle just reinforces the no-hiring response of American businesses, which has already been burdened with 4 years of Obama.

If you have 49 or less employees, your firm is exempt from ObamaCare, so adding 1 employee makes all 50 employees subject to either mandatory insurance or the per employee fine that Justice Roberts called a tax. To avoid hitting the Fatal 50, buy a machine, work overtime or hire workers who are only permitted to work less than 30 hours per week.

Reply 12 - Posted by: artman1746, 2/17/2013 12:25:56 PM     (No. 9181617)

This is just more of Obama racism ;all about the prisons and felons being overwhelmingly black. They can´t vote so he´s trying to do anything to get votes with no regard for the safety of others....especially whites. Of course it´s other blacks that will be the the victims. But you have to break some eggs to make an omelette, right?

This guy is simply an out and out black racist. It will all get clearer even to the doubters as we progress toward the end of his term. Or would that be "regress".

The stunning part is the crushing effect on states requirements for criminal background checks for certain jobs such as caring for elderly, disabled and children. State laws require criminal background checks and prohibit hiring of those convicted of violent crimes, theft, forgery etc. A facility is licensed by the state and they could lose their license if they hire people w/prohibitive offense. The EEOC says this is ok.

The EEOC is declaring open season on the vulnerable elderly, disabled and children. The background check is a tool to prevent abuse. If this is enforced, look for upheaval on the state and local levels.

It would seem that the liberal notion of ´morals and background´ are now so fantasy driven - any ´expose´ of such could well strike ´em as an emergency scenario requiring legal bars to ´examination´.

So to recap - we already have *government* workers who are routinely criminals, and since they´re the ones ´in charge´, why is it odd they´d want the rest of society permeated by their class of individuals?

Reply 15 - Posted by: LudicrousSextus, 2/17/2013 12:44:20 PM     (No. 9181647)

An ´afterthought´...

If ´lying about one´s records´ were indeed a ´criminal offense´ - Obama would be behind bars.

A most amusing thought!

The EEOC is just another government agency that should be zeroed out on funding. The list is VERY LONG and I´m waiting for the House Republicans to get off their collective arses and STOP writing the checks....

Another instance of an election having consequences, the EEOC is primarily staffed by ultra liberals, and most of those minority criminals and their family members are liberal Democrat constituencies, so what do you expect such an agency to do?

Reply 20 - Posted by: chance_232, 2/17/2013 3:48:27 PM     (No. 9181871)

Business stopped hiring convicts when they were held liable for any crimes that a convict employee might commit.

Which begs the question......if its unlawful to discriminate against convicts, can the employer still be held liable?

And this begs another question.... WHEN is a man or woman considered rehabilitated? In today´s climate, the only employment that an ex-con can hope for is part time minimum wage from a small company. There is little chance that these people will ever be afforded the opportunity to get their life in order.

Would I hire an ex-con? Maybe... Would my company? Absolutely not.

EEOC, the answer is NO. Not until you put up a $10 million bond for each and every felon hired to cover for potential damage to the company and customers.

Next issue!

It sounds like the setup for a bad joke: What did the Wall Street type say to the college president on the golf course? ... the college has "no curricular requirements that center on the American founding or the history of the nation." Even history majors aren´t required to take a single course in American history. In the History Department, no course is devoted to American political, military, diplomatic or intellectual history—the only ones available are organized around some aspect of race, class, gender or sexuality.

North Korea’s young leader Kim Jong-un is waiting for United States President Barack Obama to make a phone call to Pyongyang to discuss easing tensions on the Korean peninsula, according to Russia’s news agency Itar-Tass. The report cited United Kingdom diplomats, saying Pyongyang was demanding the U.S. president personally call Kim Jong-un as one of the conditions to relieve the current conflict at hand. Itar-Tass also quoted the U.K.’s Sky News as saying North Korea currently has eight nuclear warheads.

Recent research indicates that the number of people who do not consider themselves a part of an organized religion is steadily on the rise. Interestingly enough, though the number of those religiously unaffiliated is increasing, there is little to no trend in the number of those who express atheist or agnostic beliefs. People aren’t saying they don’t believe in God. They’re saying they don’t believe in religion. They are not rejecting Christ. They are rejecting the church. This begs the question, “Why are we losing our religion?”

Los Angeles — Some people have had it with TV. They´ve had enough of the 100-plus channel universe. They don´t like timing their lives around network show schedules. They´re tired of $100-plus monthly bills. A growing number of them have stopped paying for cable and satellite TV service, and don´t even use an antenna to get free signals over the air. There was growing buzz over the weekend that a bipartisan agreement on gun control — a deal that would expand background checks — could hit the floor as early as this week.
