Despite being told by a federal appellate court that it was unconstitutional to make a recess appointment when the Senate was still in session, the administration is standing by purported appointee Richard Griffin. Wait just a ding dong minute. If these NLRB recess appointees are still on the Board, they are definitely in contravention of the law. Recess apppointees may only serve until the end of the congressional term during which they were appointed. As of January 3, 2013, at noon eastern time, the 112th Congress ended and the 113th Congress began. At that time, any and all recess appointments made during the 112th Congress also ended. Per Article II, Section 2: "The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session."

Even a constituttional scholar as challenged as Zippy ought to be able to understand this language.

Why should His Majesty, Himself listen to mere subjects who declare the actions of His Majesty, Himself unconstitutional? And by what backwardness is His Majesty, Himself bound to act according to mere constitutions?
