As our first national Gun Appreciation Day arrives (isn’t every day in America Gun Appreciation Day?), it’s worth a closer look at the constitutional arguments made by conservative opponents of President Obama’s gun-control proposals. Listen closely to the predictable fulminations against President Obama’s recent moves to reduce gun violence, in part through executive action. Conservative blogs and Fox News have been filled with indignant protests over Obama’s “abuse of power” and the manifestation of “tyranny” by the “power-grabbing” president. Sen. Rand Paul went on the Christian Broadcast Network to accuse Obama of acting like a “king or monarch.”

When you read this you should know that this guy is a ´constitutional law´ professor at UCLA. He appears to be as qualified as 0bama. s/o It really disturbs me that we have morons like this teaching at the universities. We are doomed.

We attended the Pro-2nd Amendment rally in Htfd, CT yesterday and we didn´t see anyone ´freaking out´. We did see lots of nice gun owners, but not one of them was ´loving´ on their gun. In fact, the only people we´ve noticed ´freaking out´ for the last month is DUHmocrats who´s answer to Newtown is to punish law abiding citizens and give more lenient sentences to criminals, who get to keep their ILLEGAL guns, of course. Here in CT, Malloy has even fast-tracked the criminals out of prison, overturning the jury´s rule and the court´s sentences. Even decent folks cannot get a job here b/c the DUHmocrat run state has taxed business out of the state, so Malloy´s boys, (the fast-tracked criminals) get out and go right back to burglary, rape and murder of CT citizens, after they´ve obtained another ILLEGAL gun, of course. Think we´ll buy our next additions on the black market so we can breath easier knowing that the CT goobermint will never confiscate those./s/, or maybe not

The Executive Orders are a nothing burger, true. But the Plantation Party´s attempt to take away our God given right to defend our families is very much a fact. Even a willfully ignorant peddler of Beltway conventional wisdom can see it, if he were to open his eyes and climb out of Dear Leader´s lap for a moment. I´ve read Winkler´s book and discussed it with him in person. He´s not a bad guy and is firmly of the belief that the Second Amendment (post-Heller) protects the individual RKBA. He is a flaming liberal metrosexual, however, and IMO wishes that it didn´t.

His main point is that 2A isn´t absolute and certain restrictions are permitted. History supports that view, like it or not. Where we really got into it was over the issue of a partial or complete gun ban. We agreed that it was unconstitutionally impermissible, but I cited Feinstein and a few others in support of my belief that they´re going to try. Because eventually they are.

It was a lively meeting, and the liberal lawyers in the room kept their mouths shut. They were "outgunned."

Re: #11 - There is no debating the 2nd amendment. What #11 is espousing is a national bloodbath. His ilk will not rest until they impose the control they seek, contrary to the Constitution. His ilk fully understands they will be resisted. Their aim is to marginalize, with their "soothing" progressive psuedo-sensitivity, the lawful gun owners and the core Americans who believe in the inherent right of self defense - and not against Bambi, either. The progressive agenda seeks to disarm; there is no debating this. Traditional American conservatives will resist with force, when necessary - there is no debating this either. The #11 mentality does not care and would see bloodshed to accomplish their long term progressive aim to have all conservatives be as fish in a barrel.

It is intolerant and racist to take guns for protection away from guns owned by gays and black law abiding citizens who live in high crime black neighbourhoods.

It is hypocritical to arm the presidents security and put armed guards in his children´s school.

Most of these latest executive orders are well within the power of the POTUS and mostly completely irrelevant.

At the end of the article, the author would be well advised to look up and read the almost totally ignored Tenth Amendment.

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States, respectively, or to the people."

So, if there is not a specific delegation of a power to the United States (Feds) written into the Constitution, then the power REMAINS with the States. ALL gun regulations and laws are not part of the Constitution, and therefore are subject to State laws. Ultimately, the resurection of the much ignored 10th Amendment needs to be taken seriously now days as the Feds consistently overreach.

Exactly. There were a number of one-note posters on here when Clinton was POTUS, too.

In response to #11, the weak-minded refuse to see we are right now transitioning out of the Talking stage and into the Action stage of a civil conflict. Why should we continue to talk? Why should I worry about my ugly comment when I have received a thousand-fold in return for no good reason? A lot of people out here are like trees that bend mightily in the wind, but when the wind blows long enough, they will snap, one by one.

And all the talk and all the insincere expressions of reasonable discourse will slam into the cold, hard wall of Reality.

How do you ensure that you won’t be ostracized, denounced, or fired if you are a media celebrity, captain of industry, or high public official? For some, sexist banter is certainly no problem. Stand-up comedian Bill Maher called Sarah Palin a c–t and a tw-t, but suffered no ill consequences. David Letterman joked on air that Sarah Palin’s 14-year-old daughter had had sex with Alex Rodriguez during a New York Yankees game. There was no downside to that either. President Obama tosses around “sweetie” as he wishes. No problem with that. No one believes Barack could be condescending to women.

When President Obama needed a preacher to fulfill the closing prayer duties at the annual White House Easter Prayer Breakfast, he turned to none other than the Episcopal Church’s first openly gay bishop — who said he was as shocked as anyone at the appointment. WASHINGTON — Former President Jimmy Carter joined fellow Nobel laureates Wednesday in opposing Keystone XL, insisting that approving the pipeline would trigger “more climate upheaval” around the globe.
